| 摘 要： | 现行农村土地所有权主体制度存在一些不足之处。文章认为，必须坚持农村集体土地所有制，明确农民集体的内涵；通过修改相关立法，统一集体土地所有者的规定；建立和健全农民集体的组织机制，落实农民集体的所有权；完善外部保障和监督机制，切实保障农民对集体土地所享有的权益。
