网络著作权侵权案件管辖问题研究

网络著作权侵权案件是通过网络侵害著作权人合法权益的侵权案件,网络的虚拟性使得确定管辖的依据有别于一般侵权案件。确定网络著作权侵权案件的管辖法院必须立足于网络侵权行为的特殊性,以未来《民事诉讼法》构建的三审终审制为制度背景,有利于平等保护当事人实体权益与程序利益。原则上以协议优先和原告所在地为确定地域管辖的标准;以基层法院作为初审法院,适当兼顾案件的特殊性。

Network copyright tortuous case domination problem research

As internet is virtual, the infringement of copyright by internet is not as usual as the normal tort cases. Only based on the exceptional character of the case, the future Civil Procedure Law and in order to make a better protection of the subject and procedural interest of the parties, can we produce a rational system about jurisdiction. Principally we according to the parties/s contract and the plaint/s region determine the regional jurisdiction and take the basic- level People/s Court as the original jurisdiction. Certainly the exceptional character of the case must be condierated.
