论我国出口产品面临的反补贴诉讼

迄今为止,对我国发起反补贴诉讼的情况还是罕见的,其原因主要在于反补贴对于发起国来讲不如反倾销好用,而且欧美等主要贸易体的反补贴法不适用于中国这样的“非市场经济国家”。不过,这并不意味着今后我国也较少面临反补贴诉讼威胁,因为我国企业获得补贴的情况本来就比较普遍,同时我国的“市场经济国家”地位正在获得越来越多WTO成员的承认,况且,现在已经有加拿大等个别国家对我国发起了反补贴调查。

On China export product facing's anti-subsidy lawsuit

Up to present,there are rare cases of Countervailing lawsuits towards China.The main reason is that Countervailing prosecution is less effective than anti-dumping,moreover,the Countervailing laws of such main trade parties as Europe and America are not applicable to "non-market economy countries" like China.However,it doesn't mean that there will be less Countervailing litigation threat because it is a common phenomenon for Chinese enterprises to get subsidized.In the meanwhile,China's status as "market economy countries" is getting recognized by more and more WTO members.Nevertheless,there are already some exceptional countries like Canada commencing Countervailing investigation towards China.
