论侵权补充责任追偿制度的法理依据

《侵权责任法》第三十四条第二款、第三十七条第二款、第四十条规定了侵权补充责任,但没有明确规定补充责任人追偿权,学界对此有不同的观点。肯定或者否定侵权补充责任追偿权,应当考虑是否符合权利、效率与公平的要求,是否违背民法学的一般原理。另外,探讨侵权补充责任追偿权,还应该研究比较法理论。我国侵权补充责任追偿制度有充分的法理依据,侵权责任法司法解释对此应作扩张性解释,以完善具有中国特色的侵权补充责任制度。

On the Legal Basis for Compensation Recovery System concerning Tort Supplementary Liability

In the ＂Tort Liability Law of PRC＂, the second paragraph of Article 34, the second paragraph of Article 37 as well as Article 40 stipulate what are tort supplementary liabilities, but there is no clear stipulation about the recovery right of person reliable, for which different scholars have different opinions. Whether to affirm or deny the recovery right concerning the tort supplementary liability relies on whether it complies with the requirement of rights, efficiency and fairness and whether it violates the general principle of the science of civil law. In addition, we should also study the theory of comparative law to explore the recovery right concerning the tort supplementary liability. There is solid legal basis for China＇s compensation recovery system concerning tort supplementary liability. Therefore, the judicial interpretation about the tort liability law should give extensive interpretation to the relevant legal regulations so as to perfect the tort supplementary liability system with Chinese characteristics.
