| 摘 要： | 不同发展阶段的市场经济,对劳动合同期限制度的要求是不同的,因此,大陆法系国家劳动合同期限制度先后经历了三个阶段：一是自由竞争资本主义市场时期,定期劳动合同是劳动合同期限的唯一形式;二是垄断资本主义阶段,由于政府干预,劳动合同期限制度发生革命性变化,不定期限劳动合同成为一般形式,定期劳动合同降为例外形式;三是当前＂以不定期限劳动合同为一般形式,定期劳动合同为例外形式＂的劳动合同期限制度改革。
