| 摘 要： | 法官行使庭外调查权有利于澄清案件事实、提高诉讼效率、平衡控辩双方诉讼地位,进而促进司法的公正。但是我国目前刑事诉讼中的庭外调查制度随意性过大,需要予以完善。
