| 摘 要： | 通过分析和比较国内外已有的行政强制相关理论 ,为我国立法中行政强制执行主体的创设提供了现实立法模式和未来发展模式 ,进而为行政强制执行主体有效、合法地行使行政强制执行权 ,设计了一系列监控机制 ,包括授权控制、程序控制、监督控制等。

| Abstract: | Related theories to administrative enforcement used at home and abroad are analyzed and contrasted to offer a realistic legislative pattern as well as a future development pattern. Accordingly, for the principal part of administrative enforcement for performing the power legitimately and effectively, a series of monitor mechanism should be established, including authorized control, procedure control and monitor control. |
