| 摘 要： | 清代监狱极端黑暗。鸦片战争后,随着治外法权的丧失、国际监狱改良运动的发展以及中西法律思想的碰撞融合,以资产阶级改良派为代表的近代监狱改良思想初步形成。虽然零星散乱,未能形成严密完整的体系,但仍然为清末监狱改革作了思想上和舆论上的准备。

| Abstract: | The situation of the prisons in Qing Dynasty was very bad. After the Opium War, with the loss of the extraterritoriality, the development of the international prison-reforming movement and the collision and fusion of the Chinese and Western law thoughts, the modern prison-reforming thoughts that took the bourgeois reformists as the representatives came into being. Although their thoughts were disordered, and didn't formed a thorough and complete system, the rise of prison-reforming thoughts prepared in thoughts and public opinions for the prison reform at the end of the Qing Dynasty . |
