| 摘 要： | 政府的财政权如果得不到规制，必将遭到滥用。宪政是财政权规制的根本手段，对财政权的规制是宪政的精神所在。我国宪政的缺失导致政府财政权力的滥用，必须进行财政立宪，但该进程受到政治体制与行政管理体制的制约。
