理论进路的转向——两种经济法研究模式的扬弃

西方经济法研究的“市场失灵-国家干预”理论模式和以往我国经济法研究的内生于政府的理论模式有着不同的国情基础。在此基础上，本文认为，可吸收各自的舍理部分，立足于本土的知识资源，以正确处理政府和市场的关系为出发点，着力于厘定国家干预的边界，政府角色的重新定位为重点，立足点在于树立“社会优住，个体基础”的经济法法益观，谋求经济法理论的突破和创新，构筑开放的经济法学。

On the Combination of Two Economic Law Study Modes

The western ＂market failure-state intervention＂ theory mode and Chinese ＂ government authority＂ theory mode come from different basic conditions. This paper holds that absorbing their fair share, taking indigenous knowledge resources into special consideration and dealing with the relationship between government and market, we should focus on drawing the boundary of state intervention, reorientating the government role, setting up the value of ＂society priority, individual basis＂, striving for the breakthrough and innovation of economic legal theory and establishing opening economic legal studies.
