网上证券委托错误的责任承担

近几年来，网上证券委托交易在全世界范围内蓬勃发展起来了，但同时也带来了不少问题。其中一个重要问题就是容易发生互联网技术事故并导致网上委托错误，这时给投资者造成的损失应该由谁承担?目前世界各国对此问题均未做出明确的规定，我国实践中的作法是从事网上证券交易的券商通过格式化的“网上证券委托协议”将此风险完全转嫁给投资者承担，笔者认为这种作法是不合法，也是不合理的。最后，笔者提出券商在有过错的条件下应承担对投资者的损害赔偿责任，并实行举证责任倒置原则。

An Analysis of Accountability of Internet Commission Errors

The recent years witness a great spur of internet-base security transactions world over, but this boom has not come without problems. Erroneous commissions owing to technical defects of the internet is one of them. There have no explicit rules in the world that set up accountability for the losses to the investors caused by these mistakes. The author holds that it would be both illegal and senseless to make the investors assume these risks. The brokerage firms, instead, should be held accountable, and responsible for onus probandi at the same time.
