结构性失衡背景下我国环境规制的管理策略

我国正处于经济高速发展时期，如何维持环境保护与经济发展的协调性是全社会关注的焦点。环境规制可以有效缓解生态危机，提高环境资源配置效率。我国环境规制的实践经历了发展期、完善期两个阶段，依然存在较多问题，总体处于结构性失衡状态。我国环境规制失灵的原因包括三个方面：环境规制中的经济利益与环境利益失衡、环境规制部门之间的权力失衡、利益主体的决策与诉求失衡。为了解决我国环境规制失灵问题，应该不断增强政府部门环境规制职能，构建完善生态环境补偿机制，促进区域低碳经济均衡发展，并且尽快建立环境保护公众参与机制。

Research on Management Strategy of China's Environmental Regulation under Structural Imbalance

China is in a period of rapid economic development, how to maintain the coordination of environmental protec-tion and economic development is the focus of attention of the whole society. Environmental regulation can effectively alleviate the ecological crisis and improve the allocation efficiency of environmental resources. The development of environmental regu-lation in China has experienced two stages of development and improvement, and there are still many problems in the imple-mentation of the specific implementation. The reasons for the failure of environmental regulation in China include three as-pects: the imbalance of economic interests and environmental interests, the imbalance of power between the environmental reg-ulation departments, the decision-making of the interests of the main body and the imbalance of demand. To want to solve China's environmental regulation failure, should be increasing government environmental regulation functions, build a sound e-cological environment compensation mechanism, to promote the balanced development of low carbon economy area, and estab-lish environmental protection public participation mechanism.
