空间地上权与我国城市化进程

摘    要:空间地上权制度在美日等国城市建设中应用十分广泛.然而,我国物权法虽已于第136条规定了空间建设用地使用权制度,但该项制度的应用实践很不充分,这显然与我国城市化进程很不相称.空间地上权在我国城市化进程中作用突出.它的导入,对于破解现代城市土地问题,促进土地资源有效利用,提高城市设施一体化水平,保护物业权利人利益以及削减事业费开支、增加国家空间使用费收入等,均具有十分重要的意义.

Abstract:The institution of superficies of space was widely used in the construction of city in U. S. A and Japan. Whereas, our property right although had regulated the institution of use of special constructive sites in the 136th regulation, the practice of apply was very insufficiency which was unsuitable to the progress of Chinese urbanization. The function of the superficies of space was very outstanding in the progress of Chinese urbanization which introduction had ,very important significances to resolve the problems of modern city land, advance the effective use of land resource, promote the level of integration of urban facilities and protect the interests of property oblige arid cut the operating expense, add the earning of national special use fee and etc.
