我国弃婴收养行为存在的问题及其法律规制

弃婴是收养子女的重要来源之一,但目前由于我国弃婴救助政策及收养制度的不完善,对民间收养弃婴行为缺乏监管,导致侵犯弃婴权益和违法收养等问题的不断发生,修改完善我国《收养法》已刻不容缓。应着重从适当降低民间福利机构设立门槛,适当放宽收养条件,增加收养关系的类型,严格规范家庭收养的程序,强化收养行为的国家监督,建立试收养期制度,积极推进涉外收养和完善收养法的相关配套制度等方面入手,进一步完善我国收养法律制度,为维护和保障弃婴权益提供有力的法律保障。

Research on Legal Regulations of Adopting Deserted Babies

Deserted babies are important sources of adoptive children .But due to imperfect deserted baby aid policy and adoption system ,and the lack of supervision over private adopting ,infringement of deserted babies’ rights and illegal adopting happen frequently .Such situation allow s of no delay to modify and perfect Adopting Law .We should further perfect its legislation ,lower the threshold of the establishment of private welfare institutions ,easing the adoption prerequisites appropriately ,add the types of adoptive relationship ,regulate the family adoption procedure strictly ,intensify the national su-pervision on adoption behaviors ,establish the trial-adoption system ,promote the foreign adoption and perfect the relevant supporting system of adoption laws .Through all these measures we could maintain and protect the rights and interests of deserted babies .
