| 摘 要： | 金融机构市场退出是金融发展中不可避免的现象，也是金融稳定，提高金融市场效率的客观要求。我国已有的相关立法和实践，表明现行的市场退出制度尚存在诸多的空白和缺陷。笔者着重从市场退出制度的立法层次分析了市场退出制度的法律原则、主持机构和职责、退出方式和程序、债务解决等方面的问题，提出了相关的立法建议。
