现状与问题:农村信用合作社法律性质探析

农村信用合作社作为我国农村地区最重要的金融服务机构，一直以来承担着支持“三农”金融的重要任务。通过梳理改革开放以来农村信用合作社制度变迁的历史，我们却发现农村信用合作法制颇不完备，这无疑会对新农村金融建设产生消极影响。其中，至关重要的农村信用合作社的法律地位、财产制度、责任制度以及治理结构等法律性质并不明确，这一由现实发展状况所决定的立法困境又是农村信用合作法治的核心问题。文章从分析改革开放以来农村信用合作社性质之流变出发，以立法的视角分析了农村信用合作法制的现状，并进一步对农村信用合作社的法律性质进行了初步探讨，为农村合作金融法治提出了相关建议。

Status and Problems: An Analysis of the Legal Nature of Rural Credit Cooperatives
