| 摘 要： | 本文认为诚实信用原则可分为主观诚信和客观诚信两个方面,物权法中有关"善意"的表达实际上是主观诚信,相对于合同法中的客观诚信,二者是对立统一的关系.本文着重论述主观诚信在物权法中的适用.

| Abstract: | This article thinks the honest credit principle may divide into the subjective good faith and the objective good faith two aspects,the relations of them are both opposes and unifies. The subjective good faith or the objective good faith in the suitable process respectively has the strauss. Our country law educational world since long ago extremely stresses the research objective good faith in the contract law function, neglected to the understanding to the subjective good faith,This article emphatically elaborated the subjective good faith in real fight law be suitable. |
