论纵向限制竞争行为规制之必要性与措施

目前，我国法学界对横向限制竞争行为研究颇多，但对纵向限制竞争行为的研究则明显不足，我国竞争法对纵向限制竞争行为的规定也几乎是空白。虽然纵向限制竞争行为具有一些积极作用，但其消极影响和对自由竞争的损害也显而易见，因此反垄断立法有必要对其加以规制。欧美等主要国家在规制纵向限制竞争方面已建立了较为成熟的制度，我国应借鉴其立法经验，在立法原则和具体制度上对纵向限制竞争行为作出明确细致的规定。

On the Necessity and Measures of Vertical Restrictive Competition Behavior Regulation

Although a lot of research about horizontal restrictive competition behavior has been carried out in China, there is a clear shortage of research about vertical restrictive competition behavior, and the regulation of competition law in this aspect is almost blank. Vertical restrictive competition behavior has negative influence and harms free competition, so there is great necessity for anti-monopoly legislation to regulate it.Therefore,we should work on this based on the experiences of major western countries.
