论医院死亡救助制度

医院见死不救不仅是道德问题，还与相应法律制度的缺失有关。运用合同法理论，对近几年来屡屡发生的医院见死不救问题进行分析，指出这是社会转型期间传统的社会保障体系逐渐退出历史舞台而新的社会保障体系尚未建立完善的结果，医院见死不救恰恰是制度残缺的不良结果。在论证的基础上提出了构建我国医院死亡救助制度的设想，解决此类问题的关键在于建立一套完整的医院死亡救助的社会保障体系。

On the Death Rescue System in Hospitals

It is not merely a moral question but also a result of lack of corresponding law for the hospital to do nothing to save a dying man.Based on the theory of the Contract Law,this paper analyzes the issue of many hospitals doing nothing to save a dying man.It points out that such issue is resulting from the fact that in the transition period of the society,the traditional social security system is phasing out while a new complete social security system is still to be established.The act of the hospitals doing nothing to save a dying man is the consequence of an unsound system.Finally,this paper proposes a tentative plan to construct a Death Rescue System for hospitals in China,pointing out that the solution to such problems lies in the establishment of a social security system concerning death rescue.
