| 摘 要： | 标准与法律关系是标准化研究中的一个基础性问题。清楚划分法律与标准的调整对象,对于防止标准制定的泛化、标准的＂越权＂、妨害公平竞争和市场秩序,推动依法行政、依法治国具有重要意义,这也是＂入世＂之后WTO原则对我国政府的要求。作者在本文中对标准和法律的关系做尝试性的简要分析,并揭示了二者关系在现今中国的实质意义。

| Abstract: | The relationship between law and standard is a fundamental question in standardization research. It is of great importance to distinguish between law and standard. It is helpful in preventing stipulating for standard from overruning and exceeding it＇s authority, and from doing harm to fair competition and market order, and will drive the course of administration according to law and Rule of Law, and will accord with the principle of WTO. In the article, the author tries to analyze the relationship between law and standard in brief and open out its true meaning in today＇ s China. |
