著作权对合理使用的调整及有待完善的几个问题

在著作权法中,合理使用是一个最易引起争议而又难以被人理解的规则。为保证我国加入世界贸易组织后,更好地履行《TRIPS》的规定,我国对著作权法中的合理使用作了重大调整,部分缩小了合理使用的范围。文章通过阐述《著作权法》在我国的发展和合理使用中的"复制权"在西方的发展,对我国合理使用制度的调整及有待完善的几个问题进行了探讨。

The adjustment of the copyright on the fair use and some questions that need to perfect

In the copyright law, the fair use is one rule that causes the dispute easily and is difficult to understand. In order to guarantee that our country can better fulfill the rule of"TRIPS"after joining the WTO, our country has implemented big adjustment about the fair use in the copyright law and has partly reduced the range of fair use. Through expatiating the copyright law’s development in our country and the fair use’s copyright development in western countries, this paper discusses the adjustment of the fair use system and some questions that need to perfect.
