| 摘 要： | 企业是多元利益主体的集合,涉及极为复杂的利益关系.它需要选择受法律保护的财产组合形式和企业制度,才能保证其持续和正常运转.企业法律形态的功能即在于此.我国私营企业法律形态与相关国家比较存在着问题,需要在实践中不断完善,以鼓励投资,促进社会财富的增长.
