全球化下专利与技术标准相结合的趋势与问题解决途径

随着世界经济向区域化、全球化方向的发展以及现代科学技术在生产、贸易中作用的日益凸现,专利与技术标准相结合已经成为一种不可阻挡的趋势。一方面,专利与技术标准相结合是技术发展和标准形成的必然结果;另一方面,专利与技术标准又存在本质上的差异,二者的结合难免会产生冲突,从而产生一系列法律问题。文章首先分析了专利与技术标准相结合的趋势及其原因,然后列举了专利与技术标准相结合所产生法律问题的各种表现,在此基础上,建立了一个解决这些法律问题的简易模型,并对该模型中的三条解决途径进行了实证分析。

A Study on Trends, Legal Issues and Solutions for Combination of Patent and technical standards

With the regionalization and globalization of world economy development,modern science and technology become more and more important in production and trade.The combination of patent and technical standards becomes an unstoppable trend.On the one hand,it is an inevitable result of technology development and the formation of standard.On the other hand,there are essential differences between patent and technical standards.Combination of the two will inevitably lead to confliction and result in a series of legal issues.The article first analyzes the trend of combination of patent and technology standards,and then lists legal problems originated by combination of them.On this basis,the paper establishes a simple model for solving these legal issues,and makes an analysis on the three solution paths in the model.
