城管行为失范的行动逻辑及其规制对策——基于街头官僚视角

城管执法人员既是城市治理过程中公共政策的执行者,也是与社会公众关系最为密切的基层公务人员。城管执法人员属于"街头官僚"范畴。其执法过程存在行为失效现象,如执法程序的缺位执行、行政执法方式的选择不当、行政自由裁量权的过渡滥用等。行为失范的原因主要包括个体利己性、有限而又稀缺的政策资源、规则的非理性依赖、执法对象的非自愿性等。应采取伦理和道德教育、重塑执法流程、法律监督等来约束执法人员的行为。

The Logic of Action and Regulation Measures of City urban Management Behavior Anomie---Based on the Perspective of Street Level Bureaucrats

The city urban and law enforcement personnel are the city governance in the process of implementation, but also with the public most closely related to the grass-roots civil servants. The city urban and law enforcement personnel belong to the category of ＂street level bureaucrats＂. The process of law enforcement exists the phenomenon of behavior failure, such as the lack of law enforcement program execution, administrative enforcement mode selection, and transition of the abuse of the administrative discretion ect.. Behavior anomie include individual egoism, limited and scarce resources, policy rules of non rational dependence, object of law enforcement of non voluntary eet. We should take ethical and moral education, reshaping the law enforcement orocess, legal supervision to constraint enforcement personnel behavior.
