| 摘 要： | 作为渎职犯罪的一种,环境监管失职行为的入刑,表明了中国对环境保护的重视与远见。自环境监管失职罪从1997年《刑法》修订入刑适用至今,本罪在司法实践中,已出现不少法律适用上的困惑与难题亟需妥善解决。主要从环境监管失职罪的实施现状、存在问题、国外的相关规定以及中国所应采取的相关对策为视角,探求针对环境监管失职犯罪实施的完善对策,以期为环境保护起到加强作用。

| Abstract: | Environmental regulatory crime of dereliction of duty,is new for other accusation.But there are some wrong with the implementation.The article is aimed at explain some problems about it to improve the situation ,which is from the status of the implementation of the environmental regulatory crime of dereliction of duty,the problems met during the progress,the relevant provisions of the foreign and the countermeasures that China will take. |
