论财产权的平等保护——以物权平等保护原则为视角

物权法对财产权的平等保护体现为严格意义上的"形式平等"原则,即物权法通过所提供的一系列平等适用的规则,保障了市场经济条件下的社会成员能通过物权法获得法律上明确的预期,并由此调整和规划市场行为。"形式平等"原则是市场经济下法律对平等最佳的保护方式,我国二十多年民事立法工作的发展轨道也印证了向"形式平等"回归的立法趋势。
