失地农民土地权益保护的法律思考

城市化是人类文明进步的标志,也是我国经济和社会发展的客观要求。随着各地工业化、城市化步伐的不断加快,大量的农村集体土地被流转,成为非农用地;大量的农民成了失地农民。由于我国农村土地集体所有权主体设置虚化、征地目标泛化;征地补偿不合理、征地程序不民主和缺乏司法救济权等法律内在的缺陷,致使失地的农民不仅享受不到社会进步所带来的利益,反而成了"种田无地,就业无岗,劳保无份"的"三无"游民,其结果必然阻碍城市化的进程,影响社会主义和谐社会的构建。因此如何从法治角度保护失地农民的土地权益是个十分重要的任务。

Legal Thought on the Protection of the Land Right of Land-expropriated Farmers

Urbanization is a sign of progress in human civilization and the objective need of the economic and social development of our country.With the quickening industrialization and urbanization,a large amount of rural collective land is transferred and becomes non-farm land;A large number of farmers become land-expropriated farmers.Because the setup of ownership of collective land in rural areas of China is virtual,the target of land-expropriation is generalized,the land expropriation compensation is unreasonable,and the procedures of the land expropriation is not democratic and judicial relief right is short,land-expropriated farmers can not enjoy the benefits of social progress,have become "no-farm,no-employment,no labor insurance" floaters,the result of which certainly hinders the process of urbanization,affects the construction of socialist harmonious society.Therefore how to protect the land rights of land-expropriated farmers from the perspective of legislation is a very important task.
