| 摘 要： | 在国家正式专利制度对小企业集群创新产权的保护事实上缺失的情况下,小企业内部非正式专利对于集群创新具有重要作用.我国温州、永康、晋江等地实施的小企业集群内部非正式专利对于防范集群模仿过度风险意义重大.借鉴西方专利最优设计理论,结合小企业集群创新的特殊性,对小企业集群内部非正式专利合理化设计的维度、目标及基本思路进行初步分析具有较强的理论和现实意义.
