矿产资源占有、使用及利益分配——矿产资源有偿占用制度的理论探讨

我国长期受自然资源无价值理论的影响,对矿产资源实行无偿占用制度。而矿产资源的无偿占用导致矿产资源被无证开采、越界开采、乱采滥挖,造成大量的破坏和浪费。在市场经济体制下,建立适应社会主义市场经济体制要求的矿业开发运行机制和管理制度———矿产资源有偿占用制度,从而保障矿产资源国家所有者权益、促进矿产资源的合理开采和综合利用。文章就矿产资源有偿占用制度的必要性、矿产资源收益及其分配和建立矿产资源有偿占用的法律体系,对矿产资源有偿占有制度的理论做了探讨。

The System of Compensable Using Mineral Resource and Interest Distribution

The theory that nature resources have not value holded a dominent position in China for a long time and the system of using mineral resources no with compensation was implemented.But it brings us many problems,such as mining without license,cross-border mining,arbitrary mining and causes the destruction of mines and the waste of the mineral resources.In market economy system,we should establish new mining operating mechanism and management system-the system of compensable using mineral resources,which could be adapted to requirement of socialist market economy system in order to safeguard the state's(as ownership) rights and interests and accelerate rational development of mineral resources and their comprehensive utilization.The paper discusses the next problems: the necessity of using mineral resources with compensation,the distribution of interests from mineral dovelopment,establishing law and regulation system of using mineral resources with compensation etc.
