农民土地所有权认知与农地制度创新——基于1995—2008年实证研究文献的统计分析

研究目的：探索农民土地所有权认知的动态变化及其内在机理，提出与之相适应的农地制度创新模式。研究方法：文献资料法，统计分析法。研究结果：农民对于土地所有权的认知与法制教育无关，与外部力量的干预高度关联。研究结论：农民土地所有权认知不是现行法律文本意义上的宣传教育的结果，而是农民作为认知主体自主建构土地产权象征意义的过程。新一轮农地制度创新要赋予农民永久期限的土地使用权和对抗外部干预的救济权，以保证农地使用权的长期稳定，促使农民在长期稳定使用权的基础上建构起象征意义的土地所有权认知。

Farmers’ Recognition of Land Ownership and the Farmland Institutional Innovation in China: A Statistical Analysis Based on the Literatures from 1995 to 2008

The purpose of this paper is to explore farmers' recognition of land ownership (FRLO) which includes dynamic changes and its mechanisms in order to put forward the feasible innovation model of farmland system, Methods employed include literature and statistical analysis. The results indicate that FRLO is not related with the educations on related legal settings, on the contrary it is closely related with the intervention of external forces. It is concluded that the FRLO is not the result of the propaganda and education based on the textual meaning of current law, but of the construction process of the symbolic meaning of land property conducted by farmers as the cognitive subjects. The new round of farmland system innovation should provide the farmers with permanent land use right and the appeal right against external forces so as to ensure long-term stable land use right, and based on which to impel the farmers to establish the recognition on symbolic meaning of farmland ownership based on the primise of long-term and stable land use right.
