土地管理立法、执法思考

研究目的:剖析中国土地管理立法缺陷、执法不严的原因,提出相应对策.研究方法:文献资料法和归纳分析法.研究结果:物权法不健全、土地法缺位和土地管理法不完善影响地政管理;现行法律体系中的法律冲突、"三权"主体不分和权利制衡机制不完善是执法不严的主要影响因素.研究结论:健全立法、严格执法是土地管理工作的当务之急.

Consideration About Making Law and Executing Law in Land Management

The purpose of this study is to analyze the cause of which induces to the shortcoming of law making,looseness of executing land law in land administration and to put forward the respective measures.Methods of documents and induction are employed.The results show that the imperfection of property law,the absence of upper law or land law and the imperfection of land administration law influence the formal operation of land administration.Looseness of executing land law mainly attribute to conflict of the current department law,not clear subject of right including property,management and execution,and unbalance mechanism for right and profit. The conclusion is drawn that perfecting the legislation and executing law strictly are very urgent in current land administration.
