| 摘 要： | 在分析森林资源物权有着不同于传统民事物权特性的基础上,对现行森林资源物权法律制度存在的主体虚化、物权变动随意性大、权能残缺等现状进行了探讨,并提出了完善建议。主张建立森林资源分类管理法律制度,对公益林实行生态效益补偿法律制度,对经济林则实行自由交易法律制度和采伐申报法律制度。

| Abstract: | Because the property right of forest resource has a different characteristic from the traditional civil right of others,there need to be a different legal system to manage them.This paper thinks the current legal system has many shorts with how to manage forest resource in China,it should be improved and the best way is to establish the classified management system with them,which the public forest should be managed by ecological compensation system,and the economical forest should be managed by freely exchange system as well as disafforestation application system. |
