| 摘 要： | 在我国网上证券交易中,网络服务商提供信息传输、缓存、存储空间、搜索以及链接等服务。网络服务商侵权属于一般侵权行为,应适用过错责任归责原则。网络服务商应履行事先审查义务和事后控制义务,否则即构成过错,需要承担相应的民事责任。

| Abstract: | In the online securities trading in China,network service providers provides information transmission, cache, storage space, search, link services. Network service providers＂ infringementbelongs to the general tort ISP. It should apply to the principle of fault responsibility. The network service provider shall perform the obligations of prior review and post control obligations, or constitute a fault and bear corresponding civil liability. |
