我国社会救助造血机制及其立法完善

法治视野中社会救助方式是指通过法律创设一系列制度化规定，明确社会救助的供给主体与对象，并依靠制度建设与公共政策调整为社会弱势群体提供相应的救助服务的一种手段。确定社会救助方式的基本类型，是开展社会救助立法工作的先决条件。目前，我国社会救助制度采取以输血救助为主，造血救助为辅的救助模式。该模式救助水平有限，社会成本较高，社会效果不明显。因此，我国《社会救助法（征求意见稿）》在立法理念上应注重输血与造血两种救助方式的结合，突出造血救助的重要性，在制度层面上加强造血救助机制的立法完善。

Our Social Assistance on Hematopoietic System and Its Legislative Perfection

Form the view？ of the rule of law, the meaning of the way of social assistance is to create a series of institutionalization regulations, to make supply subject and object clear and is a way to provide appropriate relief services for vulnerable groups in society relying on institution building and public policy adjustments. Deciding the basic types of social assistance is a prerequisite of carrying out the work of social assistance legislation. Currently, China~s social assistance system mainly takes the way of blood transfusion rescue, hematopoietie rescue mode supplemented, which function is limited in rescue, and requires higher costs and social effect is not obvious. Therefore, about ＂Social Assistance Act （draft）＂, Legislators should focus on the combination of two help methods, blood transfusion and hematopoietie, in the legislative concept and at the same time, give more prominence to hematopoietic rescue and strengthen the perfection of legislation of hematopoietic rescue mechanism in the perspective of institutional level.
