社会救助措施的立法现状及其走向

社会救助措施是实现救助目的的载体,是进行价值承载的必要手段与具体方法。常规与应急措施作为现代社会两种基本的救助措施,在适用对象、适用频率、适用内容上均有差异。在"应急性救助理念"的引导下,社会救助措施的法律规范和适用面临着诸多困境。基于法理层面充分挖掘和对社会救助措施实质的全面阐述,从而确立"常规性救助理念"的立法思路,应是未来我国社会救助立法完善应当考量的重要内容。
