论产品缺陷与无过错责任原则

产品缺陷是产品责任构成要件之一,就产品责任归责原则所生分歧实与产品缺陷有利害关系。产品责任应当贯彻无过错责任原则:第一,无过错责任原则的出现是历史的进步,具有重要价值;第二,无论是何种类型的缺陷产品致害,均应适用无过错责任原则;第三,存在产品缺陷时的责任减免事由,并不违背无过错责任原则。
