The People＇s Republic of China will host the 29th Olympic Games. one of the largest Olympics in history,this August, from exact date 8 to 24. This grand Game will expect 10,500 athletes, 180,000 accredited staff, 22,000 media, and 230 VIPs by that time. There are seven major venue sites, six outside of Beijing, comprising Hong Kong, Qingdao. Qinhuangdao, Shanghai. Shenyang, and Tianjin.

Regulations on Foreign Exchange Svstem of the People's Republic of China

Anti-Monopoly Law and Its Implications for Foreign Companies in China

On August 30 2007, after more than a decade of legislative efforts, the Standing Committee of the National People＇s Congress （NPC）, China＇s top legislature, completed its third official reading of the draft Anti-monopoly Law （AML） and formally adopted it as thecountry＇s first comprehensive competition law. The Anti-monopoly Law will become effective on 1 August 2008, to guard against monopolistic conduct, safeguard competition, improve economic efficiency, protect public and consumer interests, and promote the healthy development of the socialist market economy. After 13 years of debate, the final adoption of the AML marks an important step toward an effective competition regime in China＇s move toward a market economy. This article introduces the history of China＇s Anti-monopoly Law, summarizes some of its key provisions, highlights some of the major improvements on the June 2007 draft, and discusses the major implications for foreign companies doing business in China.     

Im/Ex Rebound Continues in July

On August 11, General Administration of Customs of the People＇s Republic of China released the profile of China foreign trade import and export in July and the first seven months of this year. Foreign trade conducted by China suffered continuous decrease since last October; however, from this March, rebound results have been achieved for consecutive 5 months. The month-on-month figure has been growing steadily, though in slow pace.

The Measures of the General Administration of Customs of the People's Republic of China for Implementing the Regulations of the People's Republic of China on Customs Protection of Intellectual Property Rights discussed and passed at the executive meeting of the General Administration of Customs (GAC) on Feb.17,2009 is hereby promulgated,which take effects on July 1,2009.The Measures of the General Administration of Customs of the People's Republic of China for Implementing the Regulations of the People's Republic of China on Customs Protection of Intellectual Property Rights promulgated by No.114 Decree of the GAC on May 25,2004 shall be repealed simultaneously.

Article 1 For the purpose of regulating the Tax Preservation and enforcement measures of the Customs of the People's Republic of China, guaranteeing the state taxation and safeguarding the lawful rights and interests of taxpayers, these Measures are formulated in accordance with the Customs Law of the People's Republic of China and the Regulations of the People's Republic of China on Import and Export Duties.     

Measures for the Administration of Prohibited and Restricted Import of Technologies

In accordance with the Foreign Trade Law of the People＇s Republic of China and the Regulations o）c the People＇s Republic of China on the Administration of Import and Export of Technologies, the revised Measures for the Admin-istration of Prohibited and Restricted Import of Technologies is hereby promulgated, which shall take effect 30 days there- after. The Measures for the Administration of Prohibited ana Restricted Import of Technologies （the former Degree No. 18 [2001] of the Ministry of Foreign Trade and Economic Cooperation and the State Economic and Trade Commission） is abolished at the same time.

我国预算监督存在的主要问题是预算监督不力,人大对政府预算监督乏力。而在我国现行的政府预算监督体系中,人大对政府预算的监督占有重要地位,强化人大预算监督,需要加强人大预算监督的组织建设,完善预算监督机制,加强预算相关法规建设,增强预算监督权威。

论中国的跨国兼并审查——兼评西方对中国《反垄断法》的观点

美国和欧盟有非常成熟的兼并审查制度。2008年中国的《反垄断法》正式实施,其受到了西方的广泛关注。中国的兼并审查在实体标准和程序机制与美国和欧盟既相似,又有区别。由于中国的历史、目标和当前的问题明显不同于美国和欧盟,因此《反垄断法》在审查兼并所考虑的因素方面已超出了兼并的竞争效果的范围,而包括了兼并对"竞争者"和"国民经济发展"的影响。国际社会应给予中国发展和完善反垄断法的空间,使中国能够在不对国际商业施加负担的情况下实现其特有的目标。对于兼并审查的程序,中国应考虑发展和明确申报体系中有关"控制"的标准,并在条例中规定下来,使其更加可行,以达到在不对国家主权造成侵害的前提下减少对跨国兼并威胁的目的。

Potential Await for Tapping——Insight to cultural consumption in China

Just a few days ago, People＇s Forum Magazine and People＇s Daily made a China-based nationwide questionnaire survey on public cultural consumption inclination. The result of the survey indicated that the public cultural consumption level is low and so is the enthusiasm of public for cultural consumption. Given the international practice, since China＇s income per capita has exceeded US$3000, the total cultural consumption should be more than RMB 4 trillion. However, at present the real consumption is less than RMB 800 billion, which means that most of the cultural consumption potential was not brought out.     

影子银行、刚性兑付与宏观审慎政策

近年来,影子银行发展迅速,在满足居民财富管理需求、优化社会融资结构、支持实体经济发展的同时,也逐渐暴露出一些问题。本文分析影子银行对货币政策的影响和刚性兑付的风险机制,评估纳入表外资产的宏观审慎政策。研究发现:(1)紧缩货币政策降低信贷规模,却推动影子银行资产扩张,引发流动性"水床效应",削弱了货币政策有效性。(2)刚性兑付抬高无风险利率,扭曲市场定价机制,增加金融脆弱性和金融监管难度。(3)将表外资产纳入银行资本要求的宏观审慎政策,有效缓解了外部冲击造成的资产恐慌抛售压力,显著增强了逆周期调控效果。(4)仅有"逆风向而行"资本充足率调控还远不够,有序打破刚性兑付的重要性,并不亚于丰富和完善宏观审慎政策工具箱,这也应是构建宏观审慎政策框架的重要组成部分。
