劳动关系是指劳动者与用人单位(包括各类企业、个体工商户、事业单位等)在实现劳动过程中建立的社会经济关系.这种社会关系是一种特殊的社会关系,它主要是指劳动者同劳动组织之间,因劳动而产生的主体双方的权利和义务关系.这种权利和义务关系,在世界各国往往都是通过立法的形式来实现的.因此劳动关系一方面是所有经济活动或模式的重要内容和组成部分,具有经济属性和客观性;另一方面,就其主要的表现形式来讲,它又是国家意志的体现,是一种政治关系,具有阶级性和主观性.一定的劳动关系对国家的政治、经济文化及其它社会关系都能产生重大的影响,在一定程度上决定着社会的稳定和发展.  相似文献

产学研合作是一种知识产权成果研发的新模式,其产生和发展极大地推动了科技的进步和经济的发展.但基于技术成熟与否认定不一、知识产权归属不明晰、技术作价存在争议及利益分配不均等原因在产学研合作中产生的知识产权纠纷,制约着产学研合作的发展.本文从产学研合作的发展历史以及其中知识产权问题产生的原因入手,提出通过完善立法、健全合作机制、强化知识产权保护及转变政府职能4个途径,来解决我国产学研合作中的知识产权问题.  相似文献

随着我国国有企业的分权改制,在股票市场上发行股票筹集资本,股东大会已成为我国公司治理结构中重要一环。参加股东大会并进行投票是股东行使权利的重要手段,但目前我国上市公司的股东大会却往往演变成大股东及高管控制公司的“娱乐场”,小股东的利益受到侵害。通过对我国现行股东大会网络投票制度的深入研究分析,在吸收国外股东大会网络投票制度立法经验的基础上,提出完善我国上市公司股东大会网络投票表决制度的合理建议。  相似文献

新意一:明确了立法宗旨 劳动合同法的立法宗旨是一个纲领性问题,最终劳动合同法明确规定了"保护劳动者的合法权益".但"保护劳动者的合法权益"之说并不意味着只保护劳动者的合法权益而不保护或者排斥用人单位的合法权益,只是强调在双方合法利益保护的基础上,对劳动者给予倾斜保护,不会导致劳动合同双方主体的权利失衡.另外,劳动合同法第1条规定了"明确劳动合同双方当事人的权利和义务",这也强调了对劳动关系双方利益的保护.  相似文献

对大学生网络购买服装的消费行为进行研究,采用问卷调查的方式,对大学生网络购买服装的购买弊端、退货原因、放弃退货原因等进行抽样调查;根据退货流程构建出大学生网购服装的退货满意度评价模型并进行模糊综合评判。结果显示:大学生购物的退货产生的主要原因是试穿不方便性,放弃退货的原因主要是卖家完善的售后服务,并且根据模糊综合评判结果可知大学生满意度为较满意,因此,针对降低退货量从网络购物的售前、售中、售后三个环节提出了一系列建议。  相似文献

A series of five Strategic Management Journal articles has debated several issues concerning the role of market orientation in shaping firm performance. This debate has defined market orientation as a cultural emphasis. Yet, a large body of research in the marketing field views market orientation as an emphasis on certain market information‐processing activities. Using data from 217 firms, we test a model that includes both cultural and information‐processing elements. The findings suggest that both approaches to market orientation help explain performance, but their effects are mediated by organizational responsiveness. Thus, researchers should not only account for both definitions of market orientation, but they should also investigate market orientation in combination with other important performance antecedents. 随着我国经济的发展,环境问题越来越严重,尤其是废物处理问题,成为我们所面临的一个迫切需要解决的问题。对废物处理中的一般的违法行为,可以追究行为人的民事责任、行政责任,对于那些严重的违法行为即废物犯罪问题则应由刑法加以规制。我国刑法规定了废物犯罪.但是仍然存在不足,难以有效地惩治和预防废物犯罪,在刑事立法方面,对废物犯罪需要加以完善。  相似文献

Legislators and advocates claim that pay secrecy perpetuates the gender wage gap and that the Fair Labor Standards Act (FLSA) should be amended to outlaw these practices. Using a difference‐in‐differences fixed‐effects human‐capital wage regression, I find that women with higher education levels who live in states that have outlawed pay secrecy have higher earnings, and that the wage gap is consequently reduced. State bans on pay secrecy and federal legislation to amend the FLSA to allow workers to share information about their wages may improve the gender wage gap, especially among women with college or graduate degrees.  相似文献

Keeping in touch with progress in science and technology is one of the most important functions of R&D organizations. A study of nine engineering organizations shows that managers recognize this importance and consciously plan ways to encourage their subordinates to use scientific and technical information (STI) originating at outside organizations. The most prevalent forms of influence are routing articles and encouraging interpersonal contacts with outside professionals.
Managers especially route information and references related to sources of STI uniquely accessible to the manager. Such information includes:
—notices about and notes from meetings restricted to managers;
—unpublished material and preprints sent to the manager for review or because of the manager's reputation;
—articles from publications more likely to be read by managers; and
—information on the directions and accomplishment of competitive firms.  相似文献

This paper studies the relationship between the existing ventures of a firm and its incentives to undertake new ventures. We argue that whenever a firm undertakes a new venture, it does so with the risk that information associated with that venture will reflect on all of the firm's products. If the costs of bad news exceed the benefits of good news, the firm will be less likely to undertake the venture. This is the case in our model, in which an incumbent risks losing monopoly status in an established market should its new venture fail. Thus, incumbency can breed conservatism.  相似文献

For many decades, governments have successfully intercepted telecommunications to collect information about—potential—criminals and terrorists. A crucial part of contemporary policy is legislation that requires telecommunications providers to make their networks and services interceptable. This paper discusses two examples of interceptability legislation: the Communications Assistance for Law Enforcement Act (CALEA) in the US and the Telecommunications Act in the Netherlands, in order to focus on basic questions, considerations, and trade-offs relevant to designing legal interceptability laws.  相似文献

Recent research suggests that many workers in modern economies think that their job is socially useless, i.e., that it makes no or a negative contribution to society. However, the evidence so far is mainly anecdotal. We use a representative dataset comprising 100,000 workers from forty‐seven countries at four points in time. We find that approximately 8 percent of workers perceive their job as socially useless, while another 17 percent are doubtful about the usefulness of their job. There are sizeable differences among countries, sectors, occupations, and age groups, but no trend over time. A vast majority of workers cares about holding a socially useful job and we find that they suffer when they consider their job useless. We also explore possible causes of socially useless jobs, including bad management, strict job protection legislation, harmful economic activities, labor hoarding, and division of labor.  相似文献
