企业化政府行为的影响及其法律规范

在分析企业化政府行为涵义的基础上,把企业化政府行为根据目的和功能的不同区分开来并在制度上为其确定可行的划分标准,据以把它归入到相应的竞争法规则中。     

效率政府：政府行为企业化

关于政府的作用与效率问题，一直以来就存在着两个针锋相对的观点。在自由主义大师洛克看来，政府仅起“灯塔”和“守夜人”的作用就行了。他有句名言：管得最少的政府是最好的政府。而在凯恩斯主义看来，市场的失灵是普遍的情况，政府是经济正常运转的必须，强势政府应该是很有作为的。

我国工程招投标领域存在比较多的腐败行为，然而，如何防止招投标失灵、防止招投标中发生腐败却很少有人研究，试图从规范政府行为的角度来解决这一问题，为此从工程招投标中政府的作用这个角度出发，指出了政府在招投标中具有业主和管理者的特殊二重身份，揭示了我国招投标中政府失灵的具体表现，然后给出了规范我国招投标中政府行为的具体办法和建议，文章最后指出通过对政府行为的规范可以有效的规范招投标行为、防止招投标中腐败的发生，因此招投标中政府行为的规范迫在眉睫。     

转型期的中国城市发展与地方政府企业化

改革开放以来,随着中国社会、经济、政治等方面的剧烈变迁,我国地方政府的行为模式发生了深刻的变化,并对城市发展产生了深远的影响.结合国外地方政府转型研究和中国的政治、经济、社会背景,提出了"地方政府企业化"的概念,以指代现阶段中国地方政府在转型中普遍表现出的以追求经济利益为目标的行为模式.并将之与企业化政府、企业家城市、城市经营、城市管治等概念进行辨析.最后通过与西方地方政府转型的比较,分析了中国地方政府企业化的主要特征.

Conglomerate mergers,mutual forbearance behavior and price competition

This paper tests the hypothesis that conglomerate mergers lessen price competition through the creation of mutual forbearance behavior. This hypothesis is tested by estimating the impact of multi-market contacts on price competition in manufacturing industries. Potential interfirm contacts are computed for 195 of the top 200 American manufacturers in 1963. Measures of multi-market contacts are then constructed and introduced as additional explanatory variables in a three-equation model of the determinants of industry price-cost margins. The empirical results do not support the mutual forbearance hypothesis, and suggest that conglomerate mergers should not be proscribed on that basis.

The impact of bank competition and concentration on bank risk-taking behavior and stability: Evidence from GCC countries

This paper presents a comprehensive assessment of the impact of competition on bank fragility pre and post financial crisis period in the GCC banking market as measured by bank risk-taking behavior and bank stability during the period 1998–2016. Our results indicate that a higher level of bank competition and the greater degree of concentration adds to financial fragility. The findings further shows that during the 2008 crisis, lower bank competition maintain the stability of GCC banks. We also find that lower level of competition and lower concentration in the banking market increases the risk-taking behavior of the low capitalized, low liquid and small banks which add to fragility in the banking system. Our findings suggest that countries with greater capital stringency, greater supervisory power, greater market discipline, and private monitoring, with explicit deposit insurance schemes, higher shareholder protection, and higher legal efficiency decrease banks’ risk-taking and increase their stability. We also find that greater regulatory restrictions and higher creditor protection decrease banks’ stability and increase risk in concerned countries. We find support for both competition-fragility and competition-stability hypotheses in the GCC banking market. The results also confirm that the use of a single measure of competition is insufficient to assess the role of competition in banking stability.     

Subgame perfection and the ethics of competition

This paper integrates economics and business ethics through the use of the subgame perfection/backward induction decision rule. It is shown that textbook examples of subgame perfection differ in their ethical complexity. Specifically, predatory pricing is difficult to justify on both game‐theoretic and ethical grounds, whereas ‘poison pill’ takeover defenses have complex economic and ethical ramifications. Further, I employ backward induction to examine two additional areas of ethics and management decision‐making: product recall (the Ford Explorer and Firestone tires), and price versus advertising competition.
