In this study, we investigate the new European Union (EU) regulations in the light of the ruling by the World Trade Organization (WTO) panel on the trade in genetically modified crops. To this end, we describe: the basic differences in approaches between the EU and the complaining parties with regard to genetically modified crops, what the main arguments were of the complaining parties as well as the defence of the EU, what the final judgement of the panel was and finally, we describe the current EU regulations. We then analyse to what extent, the arguments and conclusions of the panel still hold regarding the new EU legislation. We find that parts of the current EU legislation, that is, the safety bans as they are currently in place, are in breach of the WTO commitments. Moreover, the new approval procedures have the potential to also break these rules, although whether or not they will, depends on how the European Commission acts. Whether or not the EU will be challenged at the WTO remains an open question, as the decision to fight before the WTO may be more costly than working out new bilateral trade agreements.  相似文献

Since the middle of the1990s the EU has vigorously pursued a policy of replacing non– reciprocal preferences for the developing countries in the Mediterranean, Latin America and with South Africa, with bilateral free–trade agreements. This article examines the content of these agreements and the empirical evidence on their likely effects and concludes that they are ‘broad’ but ‘shallow’ agreements. The static effect are likely to be very small or negative while the potential dynamic gains are problematic, especially regarding the concept of a ‘lock in’ to trade liberalisation, unless there are greater commitments to trade related issues by both sides and especially by the EU.  相似文献

The United States is engaged in two huge trade negotiations—the Trans-Pacific Partnership and the Trans-Atlantic Trade and Investment Partnership—that will have a profound impact on our economy and on the world trade system. These agreements can be an important template for new rules governing world trade, and they address some important new areas, such as regulatory issues. However, if they are to be a good template, U.S. negotiators have to alter some of their proposals, and these new agreements have to prohibit predatory trade practices, such as currency manipulation.  相似文献

Negotiating free trade agreements (FTAs) has been a high political priority for Norway. Today, it has agreements with 41 countries outside the European Union (EU)/the European Free Trade Association (EFTA), resulting in one of the world's most extensive FTA networks. FTAs cover about 10% of Norway's trade—a share likely to increase in the future. These agreements eliminate tariffs on a substantial number of traded products and have gradually become more comprehensive, covering an expanding range of non‐tariff areas. Hence, they may have trade‐promoting effects beyond tariff reductions as such. On the other hand, the non‐tariff provisions often do not go further than what has already been dealt with in other international agreements or practised domestically, so their overall effect may be limited.  相似文献

随着转基因技术的兴起和转基因产品贸易的发展,转基因产品的安全性日益成为人们关注的焦点.WTO框架下与转基因产品直接相关的协议包括.这两个协议的相关条款在对转基因产品贸易适用过程中存在着一系列法律问题.改进的办法是拓宽WTO规则,纳入消费者优先原则.另外,我国转基因产品立法也存在不足,需根据WTO规则进一步加以完善.  相似文献

This study examines the integration effects of four regional trading agreements (RTAs) respectively the EU, NAFTA, AFTA, and SAPTA on textile fabric trade from 1990–2005. A modified gravity model for analyzing textile trade was first generated by the fixed-effects method. Regional dummy variables were then used to identify trade creation and trade diversion effects arising from the RTAs. The results indicated that neither trade creation nor trade diversion effects existed in the EU textile trade. Trade creation in terms of imports was identified in NAFTA and SAPTA. There is no indication of shifting textiles trade from the rest of the world to the member countries with the implementation of these two free trade areas (FTAs). On the contrary, trade diversion was recognised some years after AFTA's enactment. It represents a movement towards free trade and is beneficial for the welfare of the world. This article provides empirical evidence on how textiles trade influenced by the formation of RTAs and elimination of quotas on textiles products.  相似文献

We develop a dynamic bargaining model in which a leading country endogenously decides whether to sequentially negotiate free trade agreements with subsets of countries or engage in simultaneous multilateral bargaining with all countries at once. We show how the structure of coalition externalities shapes the choice between sequential and multilateral bargaining, and we identify circumstances in which the grand coalition is the equilibrium outcome, leading to worldwide free trade. A model of international trade is then used to illustrate equilibrium outcomes and how they depend on the structure of trade and protection. Global free trade is not achieved when the political-economy motive for protection is sufficiently large. Furthermore, the model generates both “building bloc” and “stumbling bloc” effects of preferential trade agreements. In particular, we describe an equilibrium in which global free trade is attained only when preferential trade agreements are permitted to form (a building bloc effect), and an equilibrium in which global free trade is attained only when preferential trade agreements are forbidden (a stumbling bloc effect). The analysis identifies conditions under which each of these outcomes emerges.  相似文献

This paper, motivated by the so-called North–South problem in trade, analyzes ex ante trade preferences and the source of potential political conflicts regarding trade liberalization. Developing a dynamic extension of the traditional Heckscher–Ohlin model with imperfect labor mobility and tracking overall dynamic paths from the autarky to free-trade steady states, we demonstrate that in the presence of inter-sectoral migration barrier, bilateral free-trade agreements can be welcomed (opposed) by the majority of workers in a capital-abundant (labor-abundant) country, which is inconsistent with the welfare prediction by Stolper and Samuelson. This paper also proposes a numerical algorithm to solve for the entire transition path of the model under rational expectation. Our simulation experiments further reveal that preannounced and delayed implementation can facilitate a bilateral free-trade agreement by partially neutralizing short-run transitional gains and losses so as to persuade the losers to support the reform without affecting the beneficiaries’ trade preferences.  相似文献

This paper examines four claims made by Brexit supporters regarding the United Kingdom’s post-exit arrangement on trade with the EU. It reviews the nature and importance of UK-EU trade links and the possible impact on the UK of leaving the EU customs union. It argues that all four of the claims are based on incongruous arguments which are either logically inconsistent or ignore the extent of the commitment required by trade agreements that tackle regulatory barriers, not just tariffs and border restrictions. We demonstrate that the attractiveness of the UK market will progressively decline as the UK enters into additional bilateral agreements. We conclude by analysing the implications for the UK of “taking back control” of its trade policy.  相似文献

20世纪90年代以来,国际贸易发展有三个明显的特征,即国际贸易增长快于生产的增长,贸易自由化成为各国的主流贸易政策的同时贸易保护主义又增加了新的表现形式,以及多边国际经济协调机制不断强化且区域自由贸易安排也备受青睐.本文在此基础上,首先,分析了当代国际贸易增长的内在动力与有利条件;其次,总结出国际贸易发展趋势中的新特点;进而揭露了贸易自由化进程中各种矛盾现象的本质;最后,给出了相应的结论与政策思路.  相似文献

The WTO and the EU have chosen two different agreements on product standards. While the WTO's approach is primarily based on a “National Treatment” (NT) principle, the EU's approach crucially relies on a principle of “Mutual Recognition” (MR). This paper offers a first look at the comparative performance of these two principles. We show that standards are imposed for levels of externalities that are too low under NT and too high under MR. This suggests that NT should be preferred to MR when the amount of trade in goods characterized by high levels of externalities is large.  相似文献

A key element of the EU's free trade and preferential trade agreements is the extent to which they deliver improved market access and so contribute to the EU's foreign policy objectives towards developing countries and neighbouring countries in Europe, including the countries of the Balkans. Previous preferential trade schemes have been ineffective in delivering improved access to the EU market since only a small proportion of the available preferences have actually been utilised. The main reason for this is probably the very restrictive rules of origin that the EU imposes, coupled with the costs of proving consistency with these rules. If the EU wants the ‘Everything but Arms’ agreement and free trade agreements with countries in the Balkans to generate substantial improvements in access to the EU market for products from these countries then it will have to reconsider the current rules of origin and implement less restrictive rules backed up by a careful safeguards policy..  相似文献

Preferential trade agreements (PTAs) are characterized by liberalization with respect to only a few partners and thus they can potentially clash with, and retard multilateral trade liberalization (MTL). Yet there is almost no systematic evidence on whether the numerous existing PTAs actually affect MTL. We provide a model showing that PTAs hinder MTL unless they entail accession to a customs union with internal transfers. Using product-level tariffs negotiated by the European Union (EU) in the last two multilateral trade rounds we find that several of its PTAs have clashed with its MTL. However, this effect is absent for EU accessions. Moreover, we provide new evidence on the political economy determinants of trade policy in the EU.  相似文献

In this paper we consider the effectiveness of eco‐labels as a substitute for alternative, but trade‐restrictive, environmental policies. Specifically, while there are concerns that eco‐labelling requirements increase the cost of international trade, due to their potential for misuse as technical trade barriers, little attention has been given to the environmental benefits of eco‐labelling. We show that incentive problems inherent in eco‐labelling policies make it a very weak tool of environmental policy. Despite this, we argue that eco‐labelling schemes may remain popular, owing to the lack of alternative WTO compliant environmental policies. We also use this framework to consider the economic and political conflicts facing the EU with regard to its policies on genetically modified organisms.  相似文献

本文将Michaely指数纳入引力模型,并建立面板协整和面板误差修正模型研究欧洲经济一体化对中欧贸易的长期和短期影响机制。结果显示,欧洲经济一体化促使欧盟的经济小国调整自身生产和贸易结构以适应欧盟的生产贸易结构,欧盟经济大国对华贸易则保持相对的独立性。从长期看贸易转移效应是影响中欧双边贸易流量的最主要因素,而贸易创造效应、中欧双方的经济规模以及汇率因素也对贸易流量有重要影响;短期在贸易创造效应和贸易转移效应共同作用下,中国对欧盟的贸易顺差有扩大趋势。  相似文献

The Transatlantic Trade and Investment Partnership is the most important trade policy decision that European leaders have faced in many years. The new generation of free trade agreements, including TTIP, aim at deep economic integration. Thus, they are essentially focused upon the removal or alignment of standards, regulations and administrative procedures that impede international trade and investment. Therefore, TTIP goes beyond the dimensions of traditional preferential trade agreements in the sense that it not only concerns tariffs and non tariff barriers to trade in goods, but it also concerns trade in services and the foreign investment environment. Regulatory cooperation under TTIP might thus well extend into core domains of public policy, including health and food safety or environmental regulation. Regulation, however, confers both benefits and costs to society. A proper assessment of TTIP must therefore also consider the benefits of regulation to society and must embed regulatory cooperation between the EU and US into a firm democratic framework. The potential of such an agreement is substantial, due to improved market access, regulatory cooperation and greater global reach, while the downside risk is limited. While some of the arguments critical of TTIP are justified, others seem rather excessive and seem intent on stirring up unnecessary anxiety among the population. An objective and constructive discussion is crucial to ensure that the needs of the population are heard during the negotiation process and that an agreement capable of achieving majority support can be concluded. The debate over TTIP has to consider not only the economic effects of increased trade but also the legal and political dimensions of the trade agreement.  相似文献
