Künftige Sanktionen der Herbeiführung des Versicherungsfalls und der Verletzung der Rettungsobliegenheit: Die Reform des § 61 VVG und der §§ 62, 63 VVG

The contribution deals with the intended reform of the provisions of the German Insurance Code concerning (a) the causation of the insured event and (b) the rescue obligation. The focus lies on the sanctions, and in particular on whether, when the insurant acts with gross negligence, an apportionment should take place (as under Swiss insurance law), or whether the ?All-or-nothing-principle“ should be retained (the author’s view). As to the rescue obligation, the author argues against its extension to the period before the insured event occurs. The insurant should generally and independently of a rescue obligation have a right to claim the expenses he incurred when attempting to avert the realisation of a risk he had not negligently caused. The contribution concludes with seven propositions.     

Judicial Reform

A review of the evidence on judicial reform across countriesshows that those seeking to improve economic performance shouldnot focus on judicial efficiency alone but on independence aswell. It also shows that the level of resources poured intothe judicial system and the accessibility of the system havelittle impact on judicial performance. Most of the problem ofjudicial stagnation stems from inadequate incentives and overlycomplicated procedures. Incentive-oriented reforms that seekto increase accountability, competition, and choice seem tobe the most effective in tackling the problem. But incentivesalone do not correct systematic judicial failure. Chronic judicialstagnation calls for simplifying procedures and increasing theirflexibility.

Rechtsprobleme des Kapitalaufschlags

The Solvency II Framework Directive will implement the competency to demand a capital add-on as a new supervisory device. If the risk profile of the undertaking deviates significantly from the assumptions underlying the standard formula or the internal model, or if significant deficiencies in the governance structure arise, the supervisory authority can require the undertaking to hold additional own funds in excess to the Solvency Capital Requirement. The essay lines out the capital add-on’s basic principles and conditions. As to the risk profile add-on, the author particularly describes the legal problems of calculating the deviation and deciding whether such deviation can be categorized as significant. Regarding the governance add-on, more fundamental problems regarding its conditions, calculation principles, and convergent application by the supervisory authorities of the member states are discussed. Moreover the essay describes the due process for setting a capital add-on and points out legal problems concerning transparency issues and legal protection.

本文以内蒙古财经大学大学英语教学改革为例,介绍了我校近年来大学英语教学改革基本情况,指出了改革中存在的问题和解决对策.在此基础上,提出来学分制改革背景下大学英语综合改革建设思路和未来加强外语教学改革的基本想法.
