20世纪90年代以来,频繁发生的金融危机使得金融监管成为世界各国关注的重大热点话题。本文认为,当前国外金融监管呈现出分业监管向混业监管过渡、监管法制趋同化、注重风险监管和创新监管,兼顾外部监管、内控机制和同业自律,以及金融监管日益国际化的发展趋势。国外金融监管的这些发展趋势对完善我国当前金融监管提供了许多有益的启示。  相似文献

The sub-prime crisis has rejuvenated a public dialogue about the regulation of financial systems. This paper examines the impact of culture on the regulation of bank entry. Based on data from 53 countries, the paper's empirical estimations are inconsistent with the prediction of ‘public choice theory’, while supporting the ‘social choice view’ that cultural value has significant influence on regulatory policy and bank performance. The estimated structural model also suggests that social context can affect the formulation of cultural values across countries.  相似文献

This study draws on the concept of ‘regulatory space’ to analyse the evolution of financial regulation of professional football clubs in England over the past 30 years. It begins by setting out the institutional context and, in particular, the internal governance structure of the Football Association. It then discusses three periods that demonstrate how the regulatory environment is characterised and shaped by different organisations, particularly the football authorities. It concludes by arguing that appropriate financial regulation is unlikely to occur under the following four circumstances: where internal governance structures of regulatory bodies are constituted in such a way as to inhibit the process of decision-making; where powerful actors maintain control of significant financial resources and have a desire to limit financial regulation; where minor actors do not have sufficient power and leverage; and where the government is unwilling to intervene and use legislation.  相似文献

由次贷问题引发的全球金融危机凸显了美国金融监管缺失的风险和加强金融改革的重要性。在几十年的发展中,美国金融监管体系逐步演进为双层多头的分业监管模式,促进了美国金融市场的繁荣。但是危机的爆发表明这种监管体系缺乏统一监管者,无法有效防范系统性危机,因而存在监管缺陷和监管效率相对低下的问题。危机后,美国政府开始意识到有效金融监管的重要性,并着力进行实质性的改革,以减轻美国金融监管体系与其金融市场制度、金融业务模式等的背离程度。新的监管体系方案有利于提高监管的有效性和促进金融稳定,但并不能根除金融危机根源,并且可能萌生新的金融风险。  相似文献

The recent financial crisis challenged policymakers to create better supervision for both banks as well as international financial markets. Due to different political and governmental orientations, for instance, an overarching approach in European countries is unlikely. Where it to succeed in finding a conceptually closed and integrated approach in the coming years, the financial architecture of the Economic and Monetary Union could serve as an example for other parts of the world. In September 2009 the Group of Twenty (G20) took over the Group of Eight (G8) as a premier forum ,for international economic cooperation at the Pittsburgh Summit. The first achievement of the new forum, a “Framework for Strong, Sustainable, and Balanced Growth", would be tested and improved in the G20 meetings in June 2010. Considering the escalating debt crisis in the euro zone since this spring and calls for getting rid of the weaknesses of the financial regulatory system, the G20 assumed the responsibility to formulate global strategies to keep economic recovery on track and lead world economies and financial systems to get away from the mess in a more prudential and skillful way.  相似文献

Following the financial crisis of 2008, the Treasury Committee of the UK House of Commons undertook an inquiry into the lessons that might be learned from the banking crisis. Paul Moore, head of group regulatory risk at Halifax Bank of Scotland (HBOS) during 2002–2005, provided evidence of his experience of questioning HBOS policies which resulted in his dismissal from HBOS. The problems that surfaced at HBOS during the financial crisis were so serious that it was forced to merge with Lloyds TSB, another UK bank, to form the Lloyds Banking Group in which the government took a significant stake. Moore’s evidence to the Treasury Committee revealed that long before the financial crisis, he had raised major concerns with the management of HBOS and with the Financial Services Authority (FSA), the UK financial services regulator. Moore’s evidence led to the submission of further disclosures, replies and rejoinders as evidence to the Treasury Committee. Moore’s case is therefore of considerable interest to researchers of whistleblowing because it is a rare instance of high-level whistleblowing, the details of which subsequently entered the public domain. The information revealed in evidence to the Treasury Committee sheds light on the process of whistleblowing in the context of the governance and regulation of a major UK bank that subsequently had to be rescued by government intervention during the financial crisis. The paper makes a contribution to the wider literature on whistleblowing, and to a greater understanding of aspects of the financial crisis.  相似文献
