A number of major agricultural exporting countries responded to high food prices from 2007 to 2011 by imposing export restrictions on agricultural commodities in efforts to constrain domestic food price inflation. These restrictions reduced the volume of internationally traded food and exacerbated international price spikes. Net food‐importing countries were faced with growing import bills, and non‐governmental organisations that target food security scaled‐back programme commitments and appealed for increased funding. There have subsequently been a chorus of calls for the development of a formal international framework that could discipline the use of agricultural export restrictions; the agreements of the World Trade Organisation (WTO) have been targeted as possible fora for such disciplines. We present a framework in which the efficacy of such disciplines can be analysed and conclude that constraints on agricultural export restrictions are not likely to be effective within the WTO's Dispute Settlement Understanding for two reasons. First, the timelines for dispute settlement in the WTO are too long to be useful in disputes about export restrictions during periods of high food prices. Second, the withdrawal of tariff concessions, or trade retaliation, that could be authorised in such cases would not be a credible response for many complainant countries.  相似文献

Critics of globalisation object to many things, some of which can be easily understood within standard economic models, but others of which seem to reflect a view of the world that economists generally do not share. This paper attempts to identify several alternative frameworks for analysis within which some of their criticisms may be understood, with the ultimate aim of extracting testable implications that differ from standard models. Three such alternative models are suggested, all of which focus mainly on the behaviour of owners and managers of corporate capital: an anti‐labour model, in which capitalists are willing to sacrifice some of their own profits for the chance to make labour worse off; a labour‐monopsony model in which capitalists co‐operate globally to increase profits by depressing wages; and an international political economy model in which capitalists use their resources to influence the political process for more than just obtaining import protection. This third framework, which is not spelled out in any detail here, has capitalists seeking policies such as export subsidies and other means of promoting market access, and it also has them influencing the international negotiations that set the rules of international agreements and organisations, such as the NAFTA and WTO. With the conclusion of the Uruguay Round and the establishment of the World Trade Organization (WTO) in April 1994, a comprehensive set of rules emerged that affect in a pervasive manner the activities of firms on foreign markets. This body of rules is overwhelmingly presented in the literature from a trade policy or legal viewpoint. The result is that, for many marketers, WTO rules are somewhat confusing, and their impact on international business operation is difficult to assess. This paper is purely analytical and does not aim to provide any contribution to international marketing theory. Its purpose is to identify which rules, among the many the WTO system encompasses, are of direct concern to firms. It aims to expose in a straightforward manner how they may be coped with or taken advantage of by international marketers. It focuses on WTO measures, which deal with so‐called international marketing mix decisions, namely decisions pertaining to (1) entry and international distribution, (2) product and service, (3) pricing, and (4) international communication. Commitments made during the WTO Fourth Ministerial Conference in Doha (November 9–14, 2001) that are relevant to issues raised in this paper are accounted for. © 2003 Wiley Periodicals, Inc.  相似文献

Beginning in 2001, the Doha Rounds afforded World Trade Organization (WTO) members the opportunity to develop equitable trade rules between the developed and developing member states. The WTO has been successful in advancing multilateral international trade; however, since the Doha Rounds stalemate, it has witnessed the development of more than 300 Preferential Trade Agreements (PTAs) and over 500 Free Trade Agreements (FTAs). This article attempts to answer two questions: (1) has the failure of the Doha Rounds contributed to the proliferation of PTAs and FTAs, and (2) are these agreements threatening the regulatory authority of the WTO, which, in turn, reduces its ability to effectively promote and govern free trade, and its mission?  相似文献

Empirical studies have found that countries may respond strategically to the anti‐dumping petition filed against their exporters through their own retaliatory actions. Although most previous studies have focused on retaliatory anti‐dumping filings, in this paper we explore another potential avenue for strategic response—filing a complaint under the World Trade Organization's (WTO ) dispute settlement understanding. Using a panel of global anti‐dumping filings between 1995 and 2011, we analyse under what conditions countries will choose to retaliate through either an anti‐dumping petition or a WTO dispute, and to what degree these two strategies are complementary or act as substitutes. We find statistical evidence that countries are more likely to file a WTO dispute when they have also filed a retaliatory anti‐dumping petition, suggesting that these two strategies may be complementary.  相似文献

In these remarks, I argue that a plausible reason that anti‐dumping actions are so widely abused for protectionist purposes is that they represent a rare instance of essentially unilateral actions that are permissible within the WTO: under the banner of anti‐dumping actions, governments can block imports and provide their industries with import relief without fear of retaliation or demands for compensation from their trading partners. Cognisant of the great potential for abuse of anti‐dumping actions, the WTO Agreement on Implementation of Article VI represents an extraordinarily detailed attempt by WTO member governments to ‘reign in’ this potential through a detailed set of rules governing the acceptable methodologies and procedures for initiating anti‐dumping actions. But as long as the underlying incentives for abuse remain, governments are likely to continue to find new and increasingly ingenious ways to respond to these incentives without running afoul of the rules. To create incentives for the use of anti‐dumping measures that are more in line with a cooperative international environment, I suggest extending WTO compensation provisions to cover anti‐dumping actions. In this way, the WTO might in effect ‘harness retaliation’ and convert it into a tool of international order in the area of anti‐dumping actions.  相似文献

Why is it so plausible that business organisations in contemporary society use values in their communication? In order to answer this question, a sociological, system theoretical approach is applied which approaches values not pre-empirically as invisible drivers for action but as observable semantics that form organisational behaviour. In terms of empirical material, it will be shown that business organisations resort to a communication of values whenever uncertainty or complexity is very high. Inevitably, value semantics are applied in organisations first when the speakers are uncertain about which stakeholders to whom they have to address (uncertainty) or when different stakeholder groups have to be addressed simultaneously (complexity); second, when the identity of the organisation has to be described; and third, when future strategic options that cannot be expressed by quantitative terms have to be communicated. Values accordingly play a role in organisational practice when certain aspects are indeterminate. Therefore, they are a means for organisations to communicate under fuzzy circumstances. On the basis of these findings, new approaches to value management can now be formulated.  相似文献

The widely‐followed ruling by the WTO's Dispute Settlement Body against the United States concerning the latter's FSC/ETI scheme, which led to the largest retaliation award ever authorised in a dispute at the WTO, confirmed (if there were ever any doubt) that, generally speaking, direct taxes, like indirect taxes (including tariffs), are subject to the multilateral rules of the WTO, notwithstanding efforts by tax authorities to secure specific exemptions for certain direct tax measures in these agreements. This ruling reconfirmed the traditional distinction under international trade rules between direct and indirect taxes, particularly with respect to how such taxes should be treated under the subsidy and border tax adjustment rules of the WTO. It prompted the US Congress finally to pass legislation in late 2004 to repeal the FSC/ETI scheme as part of a larger overhaul of the US corporate tax system. The most recent disputes between the United States and the European Communities over assistance to large civil aircraft (allegedly amounting in each case to even more than the FSC/ETI) also encompass direct tax measures. It would not be surprising if other WTO‐inconsistent direct tax measures were identified in the future, leading to further disputes among WTO Members. Multilateral WTO rules, which are agreed by consensus, can therefore be expected to continue to be an important factor in determining how Members shape their tax policies, as they will undoubtedly want to avoid having their tax policies successfully challenged in the WTO.  相似文献

It is likely that the World Wide Web (WWW) will come to play a significant role in the marketing strategies of many organisations, even when it fails to become the dominant marketing communications channel. A framework is required whereby an organisation can assess the potential of, develop a role for, create and manage a WWW site within its marketing strategy. The WWW is an interactive channel offering a potential for many‐to‐many communications to all players in a market. Existing frameworks either fail to recognise the implications of this or else they ignore it. This paper attempts to develop a framework which invites organisations to fundamentally rethink their marketing strategies through consideration of the opportunities presented by the WWW.  相似文献

A significant number of studies have examined aspects of consumer responses towards genetically modified foods (GMFs). However, much of this effort has resulted in somewhat mixed findings which have not added real value in terms of providing viable directions for international and national organisations concerned with the labelling of GMFs. This is particularly true in an environment where labelling regulation is increasingly inconsistent and may therefore present real barriers to international trade and the marketing and sales of these food products.

The aim of this article therefore is to shed light on the extent to which the labelling impositions on genetically modified foods would impact on the overall viability of the GMF industry particularly from an international and firm perspective. To this end, a selection of literatures that cover labelling issues in Europe, USA, Canada and Australasia were distilled in order to better understand the pros and cons of labelling disclosures globally and from these present a platform for future marketing and implementation scenarios in Australia.

On the basis of this literature synthesis, we propose that the success of the GMF imperative is contingent on two levels of compliance. First, at the global level, there is need for greater international consensus regarding uniformity of standards of regulation that would allow for fair trade particularly through such bodies as the World Trade Organisation. By implication, Australia would require to adopt levels of compliance that are comparable to the stringent European Union requirements in order to be able to access those markets and any others. Second, we note that at the firm level, whilst production costs in developing appropriate labelling disclosures can be expected to rise on account of higher standards of compliance, these would be more than offset by the increase in consumer confidence as a consequence of the opportunity to make more informed choices. This in turn would generate positive Word of Mouth most likely resulting in increased uptake and adoption of GMFs generally thus allowing for disclosure costs to fall over time.  相似文献

Past studies have largely focused on how maximizers versus satisficers choose among multiple products within a given consideration set. By contrast, our research focuses on how and why maximizers evaluate an individual product based on a salient characteristic—the number of features that it has. Across two studies, we find that maximizers evaluate products more favorably than satisficers when they have many features (i.e., they are “feature-rich”), but not when they have few features (i.e., they are “feature-poor”). Further, we outline the process underlying this effect: Maximizers are more likely than satisficers to perceive feature-rich (vs. feature-poor) products as a means of signaling status to others. We additionally identify a boundary condition supporting this proposed theoretical process. Specifically, we demonstrate that when maximizers no longer perceive feature-rich products as status signals, they do not evaluate them more favorably than satisficers.  相似文献

Despite a growing literature exploring the impact of international standards on the long-term competitive position of large technology-based multinational enterprises and, as a corollary, how these firms participate in standard-setting, comparatively little attention has been given to these phenomena with regard to the internationalisation of small and medium-sized enterprises (SMEs). This is perhaps a reflection of a 'master storyline' that assumes international standard-setting activities are almost solely the purview of larger organisations. Accordingly, this paper explores how small and medium technology-based enterprises participate in international standard-setting processes and the strategic marketing advantages that may accrue through such participation, using a qualitative case-study approach involving six technology-based SMEs in Australia. Summary frameworks depicting different means of participation and marketing related benefits are presented. The findings suggest that innovative technology-based SMEs may use the international standard-setting environment and processes more strategically than often supposed.  相似文献

This paper uses 68 measures of trade policy and liberalization to ask if membership in the World Trade Organization (WTO) and its predecessor the General Agreement on Tariffs and Trade (GATT) is associated with more liberal trade policy. Almost no measures of trade policy are significantly correlated with GATT/WTO membership. Trade liberalizations, when they occur, usually lag GATT entry by many years, and the GATT/WTO often admits countries that are closed and remain closed for years. The exception to the rule is that WTO members tend to have slightly more freedom as judged by the Heritage Foundation's index.  相似文献

Workers in Asian factories producing for Western markets suffer under inhumane working conditions. Suicides at Chinese suppliers of computer manufacturers and a fire in a Bangladesh garment factory recently drew public attention to this problem. But would workers in developing countries really benefit from better working conditions and higher wages? It may be more likely that countries implementing these improvements would lose in global competition. Therefore, developing countries are limited in their ability to raise labour standards on their own. This competitive situation, however, is the very reason why labour rights have to be negotiated internationally. Existing voluntary international standards of the UN, ILO or OECD are useful but not sufficient, and trade sanctions in the WTO framework pose dangers of disguised protectionism. More promising but still imperfect avenues are Free Trade Agreements that could be used to enforce minimum ILO labour standards and transparent certifications, e.g. for fair trade products.  相似文献

Interest in third sector organisations (TSOs) is growing as their role in addressing social regeneration, especially in urban environments, is regarded as crucial by governmental and supra-governmental organisations. The challenge is increased in multicultural environments, where those from ethnic minorities may struggle to participate in the mainstream economy and society more broadly. There is an assumption that TSOs make a positive contribution to the social good of the diverse communities and client groups that they serve. However, although there have been many studies of ethicality in commercial and public sector organisations, few focus on TSOs. Furthermore, black and minority ethnic (BME) TSOs, in particular face specific pressures, caught between the high expectations of their capacity to engage with diverse communities where the public sector has failed and, in common with all TSOs, the struggle to secure the resources necessary to manage their organisations and deliver front-line services. In this article, we investigate how implicitly ethicality is constructed in TSOs, including those with a primary mission to provide support for and services to BME communities. Building on information obtained for 305 TSOs in a post-industrial city we develop a structural equation model (SEM) in order to evaluate the relationships between elements that we argue comprise ethicality. We then assess the manner in which TSOs generally, and BME TSOs specifically, vary in the manner in which they communicate their ethical purpose and the outcomes of their actions.  相似文献

This paper investigates whether three classes of donors – multilateral organisations, regional institutions and bilateral donors – tailor their mix of grants and loans to reflect international benefit spillovers and recipient‐specific benefits, derived from aid‐funded activities in developing and transition countries. To account for recipient benefit shares, donors should use a greater share of grants when supported activities yield a larger portion of international public benefits. A greater reliance on loans is appropriate when a large portion of recipient‐specific benefits are associated with the assistance. By reflecting recipient benefit shares in the grant‐loan mix, donors’ assistance also promotes allocative efficiency. Using the Credit Reporting System (CRS) database from OECD for 1980–2000, our analysis establishes that various donor classes apply different grant‐loan mixtures when supporting the environment, health, knowledge and governance sectors of recipient countries. We employ analysis of variance and other statistical comparisons of the means to investigate differences among donor classes. We demonstrate that bilateral donors do the best job in tailoring their grant‐loan mix to accord with the extent of international public good benefits embodied in the aid‐supported activity. Multilateral organisations’ grant‐loan mix is intermediate of the three types of donors, with some evidence of them relying more on grants to finance activities that possess a larger share of international public good spillovers. Regional institutions, however, do not discriminate their grant‐loan mix by either sectors or the associated public good spillovers. This finding suggests that regional development banks need to adjust their grant‐loan mix to better account for international benefit spillovers if these institutions are to warrant the increased funds to underwrite regional public goods that they have been seeking. If, however, their mix is institutionally set, then the stakeholders must give these institutions greater flexibility to tailor their grants and loans to who benefits from the aid‐supported public goods. This is the first paper to empirically ascertain whether the grant‐loan mix is tied to the inherent publicness of the aid‐funded activities.  相似文献

国际贸易与环境保护的关系是近几年来国际经济领域的一个重要问题。论文分析了贸易与环境涉及的主要问题,指出世贸组织这一多边贸易体制处理环境保护问题时存在一定的难度,问题出在世贸组织既定的原则对环境的适用性上面。世贸组织的贸易政策条款需要一定的灵活性以处理环境保护问题,否则环境保护会成为世贸组织的一个不解之题。  相似文献
