Zur Kritik der Kapitalmarktunion

This article examines the European Commission’s proposal to establish a Capital Markets Union through facilitated marketbased financing, prominently cross border securitisation. However, facilitated securitisation might raise systemic risks through a deteriorated term transformation, imperfect risk transfer and excessive leverage. It might create a new liquidity glut completely separated from the needs of the real economy. In addition, this concept is contradictory to previous efforts to properly supervise, regulate and control the European financial markets. The essay favours a regulation and control approach combined with extensive EU reforms of the financial sector.

The stability of the German labour market despite a 5.1% decrease in GDP in 2009 has been described as the German job miracle. A contributing factor was the political decision to prolong the length of eligibility for short-time working benefits. Short-time working benefits are part of the unemployment insurance, which means that all employers and employees have to contribute. Nevertheless, short-time working benefits are predominantly used by large corporations in the industrial sector and their highly skilled employees. This article therefore asks whether the funding by collected contributions is justifiable or whether short-time working benefits should be paid for by taxes, if at all.

More than 25 years after German unification, public pensions in East and West Germany are still calculated on the basis of different legally defined variables. This leads to unequal treatments, which are increasingly perceived as inappropriate. All proposals for a unified pension law have certain disadvantages, however. There is no solution which will satisfy all stakeholders. Still, the proposal of the German Council of Economic Experts, outlined and updated in this paper, has several advantages compared to others.

Zusammenfassung Die Stiftung Warentest hat in den 12 Jahren ihres Bestehens Arbeitsmethoden zur Durchführung vergleichender Warentests erarbeitet, die auch von der Industrie anerkannt und von Verbraucherinstitutionen in anderen Ländern als vorbildlich bezeichnet werden. Das Warentest-II-Urteil des Bundesgerichtshofes stützt sich auf diese Arbeitsmethodik. Anhand einer Übersicht der verschiedenen Bearbeitungsstufen eines vergleichenden Warentests wird dargestellt, welche Probleme bei der Marktauswahl, bei der Aufstellung des Prüfprogramms und bei der Auswertung der Untersuchungsergebnisse bestehen und welche Lösungen die Stiftung jeweils gefunden hat.

The methodology of comparative product testing

Stiftung Warentest was founded in 1964 by the Government of the Federal Republic of Germany with the aim of informing the public of the quality of goods and services. During the last twelve years Stiftung Warentest has developed operational methods to run comparative tests. Nowadays these methods are appreciated even by the manufacturers and have been the basis for a very important judgement of the highest German court. These methods apply to market research, technical testing instructions and evaluation problems. A graph shows the sequence of the steps which must be completed during a comparative test. Remarks are included on the problems which can appear at each step and the solutions which would be considered.

After providing some examples of contradictory economic policy advice, we characterise different conceptions of policy advice. This is possible because, in many situations, neither economic theory nor empirical analyses provide unambiguous answers to policy questions. Thus, contradictory advice by different economists is often possible without violating scientific standards. Thus, in the process of seeking policy advice, politicians and interest groups will engage scientists with similar political ideologies. In this situation, the objectivity of political advice is still possible, but only if there is an open discussion and, in the case of empirical analyses, if data are available for re-estimations.

In September 2012, in order to save the euro, the Governing Council of the European Central Bank (ECB) announced unlimited purchases of crisis-country bonds if necessary (Outright Monetary Transactions). This was a significant change in monetary policy, leading to a controversial integration with fiscal policy and endangering the ECB’s independence as well as the preservation of price stability as its primary target. To restore the strict distinction between monetary and fiscal policy and to avoid monetary deficit financing, the author proposes to forbid purchases of government bonds not only on primary but also on secondary financial markets.

Legal counselling of consumers in the Federal Republic of Germany

This contribution surveys the institutions, strengths and weaknesses of consumer counselling in the F. R. G., especially legal counselling. It is maintained that no firm borderline should be drawn between legal counselling and general economic and buying guidance. The prevailing interpretation of the German law on legal counselling (Rechtsberatungsgesetz) is held to hinder the development of consumer counselling into an integrated system for advising consumers.

In a draft recommendation, National Competitiveness Boards should be established which inter alia should monitor the developments in labour costs. The German and European Trade Unions have refused this proposal strictly. Here, as a way out, an alternative proposal is presented extending the agenda to the macroeconomic development and policy as a whole. In implementing the agenda, social partners should be included together with the other macroeconomic actors such as monetary and fiscal policy in a Macroeconomic Dialogue forum on both the national and Eurozone levels.
