The use and exploitation of natural resources is generally structured by institutions, especially by property institutions. The main objective of this paper is to present a diachronic analysis of the institutionalization of common land property in Portugal. The several types of ownership may be largely explained by common land history. We intend to draw an outline of the emergence, evolution and transition of common land from the late nineteenth century to the present day, using the matrix proposed by Heller. The economic problem of the optimal level of appropriation is recurrent in studies that analyze the economic implications of property rights. Thus, it is imperative to analyze whether or not the dimension of common land ownership is relevant to its efficient exploitation.In essence, we infer that common land ownership in the 1st period (1850–1926) may be classified as limited-access commons (limited access to commoners) with a relatively small average size of 50 ha. This common land was primarily used for grazing, firewood collecting and shrub extraction. In the second period (1926–1974), the State dictatorship invoked the public interest (forest easements) and took possession of more than 80% of common land, promoting the transition from limited-access commons to state ownership. The units of commons were aggregated in forest perimeters for Silviculture activity, the average size being greater than 3400 ha. Finally, we analyzed the institutionalization of common land ownership in the period after the democratic revolution on April 25th 1974. We concluded that the incipient legal and institutional frameworks revealed an inability to integrate an effective title to these territories to give way to a better classification of limited-exclusion anticommons. The Heller matrix approach revealed to be a useful tool, however insufficient to study holistically Portuguese common land institutionalization. In our preliminary conclusions the Heller matrix appears to be an ill-posed problem (no continuum). It allows for the reversibility between different property regimes that involve great simplifications in the epistemology of property rights.  相似文献

There is a fundamental difference in the way of merging the fragmented plots of one owner within a land consolidation (LC) in Slovakia (the Slovak Republic, SK) and the Czech Republic (CZ). All the scattered shares of a single owner in SK are merged into a minimum amount of new plots in the proportion of 1/1; the shares of one owner in CZ are merged only to a group of owners who are on the same ownership title.Through an LC project a Slovak owner automatically acquires sole ownership and the Czech one remains in an unchanged ownership in equal shares. Authors wondered what general public and the owners themselves in particular think of these two ways of merging. A simple online questionnaire for all surveyed groups (representatives of owners, public administration officials, LC designers/experts) for a virtual model territory was created. The results based on the questionnaire (563 responses, 10–25% estimated rate of return, were evaluated at the time of preparing the contribution) show that there is a clear preference (90–98%, estimated margin of error 5–16%) for the exclusive ownership. The (surprising) differences in merging as well as subsequent findings provoked an informed debate about the causes which is still pending.  相似文献

Globally, children with disabilities are significantly less likely to attend school compared to their peers without disabilities and, even if they do attend, have poorer educational outcomes. In order to understand why these inequalities persist, this study explores the barriers and enablers to accessing education. We focus on the perspectives of guardians and children with disabilities – voices that have thus far been underrepresented – complemented by perspectives from local and national level stakeholders. Data was collected in three rural districts in Nepal, using semi-structured interviews; data was analysed thematically. Overall, the research found that challenges to inclusion are complex, involving a mixture of individual, family, school, community and policy level factors. Notable barriers were attitudes towards education for children with disabilities, the low capacity of schools to provide an inclusive education, as well as the interplay of additional ‘push factors’ such as poor health and poverty.  相似文献

As China experienced rapid economic growth, non-agricultural land, particularly industrial land, expanded significantly within its peri-urban areas. This paper takes two typical peri-urban areas: Jiangyin in the Yangtze River Delta and Shunde in the Pearl River Delta, as cases, and applies landscape ecology indices to analyze land use dynamics through overlay of their land use maps from 2001 to 2010. This research reveals that local cadres such as township governments and village collectives utilize land finance as a strategy to contest the reshuffling of central-local power brought about by the 1994 tax-sharing scheme. Meanwhile, under the stringent land quota system, local cadres allocated most quotas to the industrial sector in order to encourage economic growth. However, the fragmented governance regime, including county/city, township to administrative village and natural village, led to land fragmentation, which had adverse impacts on sustainable development. In general, the research on land use of peri-urban areas requires a comprehensive perspective of social, economic and institutional aspects.  相似文献
