Concerns have arisen over employers' collection and sharing of information about employees, especially employment references. As a result of the dramatic growth in the number of lawsuits brought by employees, many employers have seriously curtailed the information they release concerning current and former employees. However, even the refusal to release information carries a legal risk. Employers who do not obtain information concerning applicants can be liable for negligent hiring, and those who knowingly withhold negative information regarding their former employees may be liable for negligent referral. This paper explores these expanding liabilities and suggests strategies to allow employers to manage the risk of communicating employee references. 相似文献

当机组在技术记录本上记录或口头描述听到飞机异响时,经常会成为令地面人员很头疼的一件事情,特别是机组无法准确描述声音的类型和来源时,需要经过多个航段的反复判断,甚至是地面人员进行跟机观察,才能最终排除。本文从驾驶舱异响的类型和声音来源,发生的阶段进行分析,以期能为故障的排除提供参考。本文所指异响是指飞行员在飞机滑行、起飞、爬升、巡航等阶段听到的异常声音。 相似文献

The litigious environment surrounding employers today has caused them to be overly fearful of providing candid yet adverse employment references. Their attempts to minimize litigation risk created by the dismissal of a vindictive employee have clouded their judgment when asked to assist in the dissemination of employee information. This is alarmingly illustrated by the growing number of employers who have blindly adopted a neutral reference policy. Unfortunately, indiscriminate application of this policy will not necessarily preclude litigation, but, rather, foster it. It is imperative that employers carefully weigh the tangible and intangible costs of a reference defamation suit against their duty legally, ethically, and managerially to disclose vital information about a former employee. 相似文献

In the past decade, there has been a multiplicity of lawsuits by employees against former employers based on defamatory references.
Many of these lawsuits have proven to be successful and have caused wary employers to use great care in providing references.
A number have gone so far as to refuse to provide references at all, instead adopting a “no-comment” policy, often on the
advice of legal counsel. This article reviews defamation laws within the context of employee references. Recent cases and
trends are analyzed, guidelines to avoid liability are suggested, and a critique of the traditional legal advice of “no-comment”
