本文以习近平总书记多次强调坚持农村土地农民集体所有、坚持“统分结合”发展集体经济与合作经济的重要讲话为指导,客观评析了主张土地私有化或变相私有化的四个错误观点:评析了“农村土地集体所有制产权不清”的观点,认为法律对土地集体所有权作出了非常清晰的界定;评析了“土地私有制是农村土地改革方向”的观点,认为这种主张的实质是通过永久性地固化原有的家庭土地承包关系来搞农村土地私有化,无视和否定了习近平总书记所强调的壮大农村集体经济应注重“统分结合”双层经营的思想;评析了“农村土地私有化会使农民更为富裕”的观点,认为私有土地的自由买卖并不能使农民实现权利与结果的公平,绝大多数农民也不可能通过农村土地私有化实现全面小康和共富共享;评析了“‘一田两主’制度是农村土地改革有效途径”的观点,认为这一论断是通过实际架空农村土地的集体所有权来变相主张农村土地私有化。  相似文献

Land system reform (LSR) helps to protect farmers' rights and interests and national food security. China is a country dominated by agriculture but insufficient arable land resources. The contradiction between man and land is prominent. To alleviate the man-land contradiction, the Chinese government has carried out a series of LSRs, especially in the past half century. Extensive and in-depth studies have been done on the process and stage characteristics of China's LSRs, but the systematic analysis on the necessity, problems and key measures to deepen the land system reform is still insufficient. Based on a systematic review of the history of the evolution of China's LSRs, this study firstly analyzed the key issues and new challenges existing in or arising from China's land system, then put forward the necessity of deepening the reform of land system, and discussed specific measures taken to deepen the reform of land system in China at present and finally pointed out the future LSR’s direction. The results show that China's rural LSR has gone through five stages in general since 1949. The key problems existing or arising from the current land system in China include unclear subject of land property right, serious inefficient utilization of land resources, rapid farmland conversion and conflict between farmers’ interests and land system. The dual land system in urban and rural areas has severely restricted the integration of social and economic development in this country. The Chinese government is actively promoting the reforms of rural agricultural land, collective operating construction land and homestead to further remove the dual institutional barriers that hinder the establishment of an integrated land trading market. The vision is good, but there is still a long way to go for China's LSR. The direction of China's rural LSR is to make the property rights relationship clearer, the farmland rights more complete, the transfer transactions more market-oriented and the property rights’ protection more equal. Deepening the rural LSRs is helpful to improve the efficiency of land resource utilization, safeguard the rights and interests of farmers, promote the coordination of human-land relationship, and inject new vitality and momentum into rural revitalization. Cooperative promotion of land resource capitalization reform and household registration system reform is the key area of land system reform in China in the future.  相似文献

China’s central government is promoting a new round of land reform in its rural areas, the core of which is the so-called ‘three rights separation system’. In attempting to achieve the double goals of developing agriculture and maintaining the basic stability of rural society, central policy makers want to separate the original household right of contractual operation into a contractual right (right of disposal) and an operation right. When formally adopted, these two rights, combined with the village collective ownership, will constitute China’s new structure of farmland rights. Many local governments are already using practical approaches involving the separation of the three rights, providing a valuable reference for its formalization in the future.In this paper, we analyze four relevant existing approaches by case studies of four representative projects. The results show that, while all four have in different ways reached the goal of increased scale of farmland operations, all are facing different contradictions and conflicts among the collectives, local governments and farmers, due to different farmland interests, demands and endowment problems. In response, a new framework is developed involving three rights separation, entailing some new meanings. This involves the repositioning of the four leading players in the distribution of farmland rights − the state, collective, part-time farmers and professional farmers − in order to realize the free transfer, monetization and redistribution of farmland rights to meet the demands of all the parties involved. With this framework, collective ownership is limited to the management of the award and recovery of the contractual right instead of specific agricultural operations. The introduction of a contractual right exit mechanism encourages the contractual right to be sold back to the collective for awarding directly to the professional farmers. In this way, the transfer of the operation right to professional farmers is encouraged as far as possible to enable them to increase their operating area and agricultural income.  相似文献

[目的]从新制度经济学视角梳理农村土地"三权分置"的制度变迁过程,并对"三权"各自的权能进行分析,针对现存集体所有权主体缺失、土地承包权权能混乱、土地经营权性质不清等问题解释其原因并提出对策建议。[方法]运用文献综述法、对比法对农村土地试行"三权分置"后集体所有权、农户承包权、土地经营权各自权能进行划分和界定,理顺三者关系。[结果](1)"三权分置"是农村土地产权权能的进一步分解与细化,集体所有权被赋予更完整的土地所有权能;(2)"三权分置"过程中承包地流转路径得到进一步强化,打破土地承包经营权的"成员权"限制;(3)土地经营权的市场性功能与农户承包权的福利性功能同时增强,进一步减少土地对农民的束缚。[结论]"三权分置"是解决农地无人耕种、推动农村土地适度规模经营的重要途径,合理界定"三权"的权能、理顺"三权"的经济学关系、破解法律制度障碍是"三权分置"的改革重点和方向。  相似文献

Land held under customary tenure has proven difficult to register and release for private enterprise globally. This is because the costs of developing secure rights to land held under communal ownership is high given that such ownership rules out a ‘pay-to-use-the-property’ system while punitive negotiation and policing costs make a ‘pay-him-not-to-use-the-property’ system ineffective (Demsetz, 1967, p. 355). Here I document reforms to institutions governing access to land held under customary title in Papua New Guinea that has imbedded collective ownership whilst allowing for a ‘pay-to-use-the-land’ for private enterprise. Reforms put in place over the past decade have allowed for voluntary incorporation of landowning clans, the registration of their land, and the leasing of this land for up to 99 years. The ongoing reforms provide lessons both for Papua New Guinea and for others wrestling with the challenges of making available land held by customary groups for individual enterprise.  相似文献

In China, the types of immovable property objects cover not only land (a typical immovable property object) but also buildings, sea areas, forests, etc., and the general idea of unified registration of immovables (as the newest development and hottest topic in field of land administration in China) proposed by Property Law of the People’s Republic of China (2007) is not detailed until 2014 when “Interim Regulations on Real Estate Registration” was enacted and would come into force in 2015. This paper focuses on modeling of unified registration of immovables in China whose cores rely on “4 unifications” (i.e., unification of registering basis, unification of registering authorities, unification of information management platform, unification of registering books) using the world-wide advanced standard LADM (Land Administration Domain Model). In detail, the typical 8 immovable property rights (right to use construction land/forest land/sea area, ownership of houses/forests/marine structures, right to contractual management of arable land/grass land) are firstly introduced; then change of register types before and after unified registration (as one important component of “unification of registering basis”) is described; later, comparison of register procedures reflecting “unification of authorities”, “unification of information management platform” and “unification of registering books” is modeled using LADM where parties, 3R, spatial units package are greatly referenced which is followed by elaboration of a newly proposed URDMIPO (Unified Registration Data Model for Immovable Property Object). China’s recent collective forestry property rights reform (CFPRR) is regarded as the third Land Reform and has been implemented to accelerate China’s rural restructuring. In departing from previous top-down policy changes, the CFPRR has focused on local collective practices and actions. It indicates a shift in China’s rural governance, away from direct intervention towards support for local collective actions. Based on a case study of Hongtian Village, the origin of the CFPRR, this article analyses the process of insinuating collective action and the impact that this has had in creating a new cultural understanding and acceptance of collective forestry property rights. In contrast to the relative insecurity of tenure that can accompany many reforms of the governance of common pool resources, the paper suggests that the success of the ‘Hongtian model’ mainly lies in high levels of process engagement by local people and effective interaction between villagers and the government. While not addressing all the issues associated with the inefficiency of the previous collective approach to forestry, the paper suggests that there are many transferable lessons to be learnt from the CFPRR, both within and beyond China.  相似文献

建立城乡统一和公开竞争的土地市场,是完善城乡土地统一管理的核心。只有建立城乡统一的土地市场,才能发挥市场对土地资源配置的基础性作用,才能在征地过程中彻底消除集体土地和国有土地的产权歧视,从而从根本上阻止征地冲突。构建我国城乡统一的土地市场应分三步走。第一步,解决城乡统一的土地市场的市场主体问题;第二步,在农村集体土地产权清晰的基础上,推进农村集体建设用地使用权出让市场,农村集体农地承包经营权流转市场和农村集体土地所有权的建设;第三步,农村集体土地和城市国有土地在同权下自由竞争、平等交易,达到自然融合。  相似文献

研究目的:归纳分析2015年国内外土地管理领域的研究进展,展望研究趋势。研究方法:文献统计法。研究结果:2015年国外土地管理研究侧重于土地利用冲突及应对机制、土地权属效应、土地纠纷解决路径等方面,国内研究更多关注土地制度改革、土地市场管理与调控、不动产统一登记制度、自然资源资产管理、土地政策与法律,以及土地用途管制与耕地保护等方面。研究结论:2015年土地管理领域在土地管理体制机制建设等方面的研究进一步加强,针对改革实践中的热点问题研究比较突出,有价值的基础理论研究尚显薄弱;2016年将重点关注土地管理体制机制创新、农村土地制度改革、不动产统一登记制度、自然资源资产核算及管理体制、土地法学理论与实践等研究。  相似文献

"三权分置"是农地制度改革的重要成果,为提升农业经营效益提供了制度保障。农业经营的实践形态显示,土地经营权的设立并未提升资本化耕种的农业经营收益,也难以提升村集体范围内农地产权正式转移的水平。农业经营体制在"统"的层面缺乏可操作性的产权制度方案,阻碍了农地产权设置在"分"的层面发挥出高效的制度效能。切实回应农地利用中实际耕者的地权诉求,解决农地细碎化、村集体内土地经营权流转价格过高、土地经营权配置不充分、土地经营权流转后的社会纠纷等问题,需要围绕农地高效利用,在"三权分置"下充分发挥集体土地所有权的管理权能,以集体土地所有权统合土地承包经营权和土地经营权。  相似文献

This article is intended to conduct a three-dimensional examination of China’s rural land rights and the complex dynamic among political power, economic capital, and farmers’ rights during the past seventy years. First, the study takes a close look at the historical changes in the nature, scope, and ownership of land property in rural China during four significant time periods from 1949 to 2019. Second, it uses Ronald Coase’s theory on property rights in dissecting the four paradoxes and dilemmas in China’s rural land ownership, including the extent of clarity and stability of land property rights, the “three rights system” (the rights to ownership, contracting and operation of land) and three stagnations in defining and exercising such three rights, the simultaneous shortage and waste of land resources, as well as the restrictions on land transactions and the requirement to protect collective property. With examples derived from selected evidence, the article documents how both political power and economic capital have worked together to deprive farmers’ land rights. It concludes with a critical analysis of the current status of China’s rural economy, the problem of applying Western economic theories to China’s reality, as well as the theoretical definition, legal protection and policy parameters of land property rights in China.  相似文献

耕者有其山是集体林权制度改革所追求的宗旨。从福建省闽中溪乡林改中发现,由于改革过程中存在着政策排斥、资本排斥和信息排斥等因素,大部分农民并没有获得应有的林地承包经营权,导致林权集中到某些经济实体以及少数人手中。这种非正常的集体林权集中现象的出现,不仅拷问闽中溪乡林改的效率与公平原则是否得到兼顾,还对普通农民的生产生活造成消极影响。  相似文献

研究目的:深入挖掘农地依赖性、农地处置方式与农村转移劳动力市民化意愿之间的内在关系,以期为农村转移劳动力自由选择市民化提供理论支持。研究方法:结构方程模型。研究结果:农地资源禀赋、农地功能认知、农地产权安全性、农地产权认知及农地流转服务均通过影响农地处置方式间接对农村转移劳动力市民化的决策产生影响,其中农地产权安全性还会直接影响农村转移劳动力市民化的决策;农村转移劳动力市民化过程中更倾向于以农地转出方式处置农地,农地产权认知是影响农村转移劳动力市民化意愿的最重要因素。研究结论:为缓解农地对农村转移劳动力市民化的束缚,政府须加速推进农地"三权分置"政策实施,健全农地流转市场及其配套制度体系,构建有效的农地退出机制并设置农户农地退出门槛。  相似文献

研究目的:探讨农村土地所有权、土地承包权和土地经营权的三权分离改革是否符合法学原理,研究如何推进相应的制度建设。研究方法:文献资料法,归纳演绎法,比较分析法等。研究结果:土地承包经营权不能分离为独立的土地承包权和土地经营权;土地所有权是法律概念,而土地承包权和土地经营权不是法律概念,因此农村土地三权分离存在明显的法学悖论。研究结论:法学中的权利与经济学中的产权具有较大的区别,必须在物权债权二元财产权体系中确定农村土地的权利结构。  相似文献
