From male to joint land ownership: Women's experiences of the land tenure reform programme in Rwanda 下载免费PDF全文

During the post‐genocide period, the Government of Rwanda embarked on a land tenure reform programme that culminated in a land registration and titling process in 2009. This paper intends to capture women's experiences in relation to this programme. The empirical data were collected in Musanze District using a household survey, semi‐structured interviews, and focus group discussions. The main findings reveal that there is support of the general idea that women should benefit from the land tenure reform in Rwanda. However, there is some criticism towards parts of the land laws, and women have limited actual knowledge about land‐related laws. With land titles, women mostly have a say on the land use decisions requiring each of the spounses' legal consents but not on the daily management of land and its produce. Finally, the paper reports the persistence of social norms and culturally biased gender ideologies affecting the effective implementation of land‐related laws and policies. Therefore, the paper underscores the need to build the implementation of new laws and policies on a good understanding of customary practices to strengthen women's land rights in Rwanda. 相似文献

Family land is a form of communal tenure found in some of the countries of the English-speaking Caribbean inclusive of Trinidad and Tobago. It has been problematic to administer, is sometimes the source of land conflict and litigation, it has been seen as the cause of many land-related problems such as land degradation and fragmentation, and has therefore been targeted for eradication by land title registration programmes. Informal occupation of many years standing on state and private land is also widespread in Trinidad and Tobago. Recording the existence of these extant extralegal but legitimate rights would go a long way to improving the land administration and the security of tenure on these lands. 相似文献

Rural land rental markets in China play an increasingly important role in the transformation of the agricultural sector. This study focuses on the rural land rental market in the Xishuangbanna Dai Autonomous Prefecture in Southern China, a mountainous region, where rapid changes in land use have taken place with the transition from traditional agriculture and a tropical rainforest to rubber monoculture. Notably, we assess the impacts of population aging, land tenure security, and ethnicity on the participation of smallholders in the land rental market. The analysis suggests that a higher proportion of older people in a household increases the likelihood of renting out land and reduces the probability of renting in land, implying that population aging fosters land rental market development by transferring land from older to younger farmers. We also confirm that the availability of a land tenure certificate has a significant and positive impact on the renting out of land. Furthermore, ethnic minority groups are less likely to rent out land, indicating that land rental markets are ethnic sensitive. Additionally, specialization in rubber farming, household wealth and the altitude of household location also influence participation in the land rental market. 相似文献

The study examines the strategies that people use to secure their interests in land in a peri-urban Accra customary community. In a contested chieftaincy, customary leaders sell agricultural and virgin land to strangers for residential purposes, causing conflict and altering traditional livelihoods, and the proceeds of the sales do not flow to members of the lineage group. Violence and murder, involving land guards hired to defend different land claims or to drive farmers off their land, have occurred. The case confirms theory describing the behavioural patterns to be expected during major social change typically found in peri-urban areas when government is unable or unwilling to enforce the law. The flexible, negotiable rules characteristic of customary systems can be manipulated by individuals seeking power and control over land. Accepting that customary land administration is here to stay, the case supports the view that the customary system needs major reform to incorporate local-level checks and balances on land administration to make customary leaders accountable as fiduciaries. In terms of registration usage theory customary landholders in the study area saw title deeds as marginally useful in their agricultural lands but not in family compounds, whereas for strangers registration is essential. 相似文献

Changes in land use and land tenure can influence both physical fragmentation and ownership fragmentation of landscapes, with implications for biodiversity. In this study, we evaluated changes in land use and land tenure in the Tijuana River Watershed, a region of high biodiversity and endemism, following the implementation of a new Agrarian Law which allowed for privatization and sales of communal land (ejidos) beginning in 1992. In order to understand changes in land use and cover, we constructed maps from aerial photographs and Aster images and measured changes between 1994 and 2005. In order to understand changes in land tenure, we collected data from Mexican government sources on ejido land size, ownership, and sales, and we conducted 55 structured interviews with ejidatarios in the watershed. Our results demonstrate that land-use/cover change between 1994 and 2005 was dominated by an increase in urban area and grasslands, and a decrease in coastal sage scrub, chaparral, and, to a lesser degree, agriculture. In particular, the conversion of coastal sage scrub has left a far more fragmented landscape than existed in 1994. In addition, most of the ejidos in the watershed, as well as individuals interviewed, had participated in some stage of the land certification and titling process allowed by the new Agrarian Law, resulting in substantial changes in land tenure. However, land tenure security appeared to play a larger role than a desire to sell land and, contrary to studies from other regions, full title to the land was obtained in a range of urban and rural settings, rather than primarily on land closest to urban zones. Our results suggest that past predictions regarding future urban growth and fragmentation of native vegetation in the region have proven accurate and highlights regions of change that merit further study. 相似文献

Land tenure regime is considered one of the most crucial assets determining viability of urban agriculture, especially in terms of investments. Many authors have built on traditional agricultural theory that only land ownership and (formal) secure land tenure can incite investments into farming, thus stressing the need of secure land tenure for more prosperous urban agriculture. However, these statements are often built on weak or nonexistent empirical evidence. This research aims to contribute to the discussion on land tenure for urban agriculture by mixed-method exploration of the above-mentioned theory. Additionally, we propose a farming investment index which measures the level of investments by using non-monetary information obtained from respondents. The results of our study show that land tenure security for urban farmers is often seen as a rather narrow concept, focusing only on legal tenure security but omitting its other dimensions such as perceived and de facto tenure security. Nevertheless, all three dimensions of tenure security positively influence investments to urban agriculture. 相似文献

A high level of fragmentation of farmland ownership is an important underlying cause of land degradation and, at the same time, an obstacle to sustainable land management. This study makes the first-ever analysis of long-term trends in the rate of fragmentation. Our study covers the period from the earliest stages of the current form of ownership patterns at the end of the 18th century until the present day. On the basis of significant predictors that have been identified (initial fragmentation, population growth, historical development of inheritance laws and of the land market, natural soil fertility and landscape type), we go on to project probable developments for the period from 2016 to 2045. A total of 102,984 land parcels in 56 cadastral units in the territory of Czechia have been analysed on the basis of data from four years (1785, 1840, 1950, 2015). Our study considers the development of two basic indicators of fragmentation – Mean Parcel Size and Number of Owners per 100 ha. The Mean Parcel Size has decreased over a period of 230 years from 1.08 ha to 0.64 ha, at a mean rate of −0.26% year−1. During the same period, the Number of Owners per 100 ha has risen from 17.50 to 79.66, at a mean rate of 0.61% year−1. A detailed analysis of the development trends confirms significant spatial variability and also time variability of the rates of the two indicators. The analysis also shows their mutual complementarity: growth in the rate of one of the indicators is usually accompanied by a drop in the other. The general trend that we project for the territory of Czechia in the upcoming 30 years is that there will be further diminution of the physical size of land parcels (continuing fragmentation of land parcels) accompanied by a reduction in the Number of Owners (defragmentation of land ownership). 相似文献

This paper reports on a research effort to gather and analyze rural land value data during a period of unprecedented growth in Chilean agriculture. This information is important to understand the geographical distribution of gains associated with the transformation of the rural sector during a period of rapid development, trade liberalization and transition toward a predominant emphasis on export earnings in agriculture. A large set of data of rural land transactions for 1980, 1990, 1997 and 2007 were collected from a sample of land registry offices. Results show notable declines in the physical size of transactions, significant average annual rates of increase in real per-hectare values, and a small-parcel premium for rural land associated with non-farm land use. Overall real land values have increased faster than the average annual growth rates in the agricultural sector’s value added, suggesting that land owners have gained proportionately more than other claimants to sectoral income. Tests show significant geographic disparities in annual rates of land appreciation across regions and municipalities. Consistent with differential net gains due to integration into world markets and the geographic heterogeneity of suitability for different land uses, northern areas, with greater emphasis on export-oriented crops, have experienced the highest average rates of annual real per-hectare value growth, in the order of 7 percent, while southern areas, emphasizing traditional crops and pastures/livestock, have experienced growth rates of half that. Land exploitation, as an important strategy to mitigate farmland loss and stabilize grain production, has been adopted to compensate farmland loss due to rapid urbanization in China. Bounded by the limited capacity and obvious spatial variations of national farmland reserves, it is essential to arrange land exploitation activities timely and reasonably. In this study, we propose an indicator for the status of regional land exploitation, the Exploitation Degree, to facilitate an overview of land exploitation programs in China at both provincial and prefectural levels based on project data from 2006 to 2012. To further our understanding of the regional features of land exploitation activities, we employ the Lasso model to identify and quantitatively assess influencing factors on land exploitation. Our study shows that: (1) contemporary land exploitation practices in China are significantly inconsistent across exploitable farmland reserves. Some areas are greatly over-exploited and such irrational land exploitation has been persistent; (2) related national land plans designed to guide land exploitation efforts centered on resource-rich regions and critical areas do not function as intended. Therefore, we suggest that Chinas land exploitation policy shall be improved by reconsidering the orientation of land exploitation policy, coordinating land exploitation activities with productivity improvements and eco-system protection, and enhancing the power and scope of the plans in controlling and guiding land resource management. 相似文献

Contestation over land is a central element of urban food systems. This paper examines how Ghana’s dual legal land system affects urban farmers. Situated within the “emancipatory planning” discourse, the paper investigates how farmers navigate customary and statutory land rules using tactics that include compliance, opposition and adaptation. Based on field work conducted in urban and peri-urban areas of Accra, the study demonstrates that farmers access land by working around, outside, and within the rules of the dual legal land system. The landowners on whom urban farmers depend also both comply with and violate these same rules. This system perpetuates inequities. Food systems policy and planning must address the structural and systemic inequities that are reinforced by the rules of the land game. The paper concludes with some reflections on how local and national policy and planning can do a better job in supporting urban food production in contexts characterized by complex, dual legal land systems. 相似文献

This article uses ethnographic evidence from Tigray to revisit the debate on informal rural land markets in present-day Ethiopia. It explores informal farmland rental from a historico-anthropological, micro-analytical perspective in relation to the formal allocation of land use rights and to other informal land transfer practices. It shows how different rationales for land rental give rise to different socially embedded tenancy configurations. On the basis of this empirical evidence, the paper questions the appropriateness of the common idea that in Ethiopia ‘the land rental market is expanding’. It argues that research and policy thinking on land in Ethiopia could gain analytical power and relevance by adopting a less monolithic and abstract view on people's informal land transfer practices. 相似文献

Public land development is an approach where the public authority acquires land for development, services the land with public infrastructure, and transfers the serviced building plots to private building developers or self-developing end-users. Motivations to use public land development can be divided to planning goal related motivations and financial motivations. In this paper, we study management of public risks related to the use of public land development by analysing case studies located in Finland and the Netherlands, countries known to have strong tradition in public land development. Our findings indicate that, whereas public land development has efficiencies in managing the risks related to the achievement of public planning goals, the management of the financial risks related to the public land development approach can be remarkably difficult even in countries with wide experience in public land development. 相似文献

Sustainable land use, targeted poverty alleviation (TPA) and integrated urban/town development are key issues for the poverty-stricken counties of China. This paper explored the spatio-temporal pattern and driving forces of construction land change in Longzhou, a typical poverty-stricken border county in southwest China, based on high-resolution remote sensing images and field investigations. The results showed that, from 2011 to 2016, the construction land in Longzhou increased by 10.08%. The largest increase shown by urban built-up areas (37.74%) followed by rural residential (25.48%), industrial and mining (20.96%), and transportation areas (15.49%) as well by tourist facility areas (0.33%). The accelerated urban development, rural housing construction, and construction of industrial parks and transportation facilities are main factors driving construction land expansion, while the implementation of TPA strategy and the booming of border trade activities are important policy drivers of the construction land expansion. Some of the major implications for improving poverty-alleviation-oriented land use policies were further discussed. The authors argue that land use policy innovation could play a key role in breaking the Matthew effect (poor get poorer, rich get richer) of China's uneven regional development and generating and accelerating the transformation development of poverty-stricken counties. It is fundamental to meet the demand of construction land for TPA, meanwhile raise the intensive level of land utilization. The authors suggest that the government need to further improve and implement preferential land use policies for poverty-stricken counties from the provincial level, appropriately increase the quotas of construction land, and effectively strengthen the rational, efficient and intensive use of the quotas of construction land, and provide solid land policy support for poverty alleviation and thus achieve the Sustainable Development Goals with higher quality. 相似文献

The recent increase in underused land, such as outdoor parking lots and vacant areas, is a serious problem that has led to the decline of central areas in Japanese local cities. To develop these land lots, the distribution of underused land as well as factors to transform these areas must be analyzed. However, the secular changes in underused land are not understood quantitatively, and transformation factors have not been analyzed from the viewpoint of underused lot types.In this study, we constructed a database of underused land using housing maps on GIS. Then we analyzed the relationship between the changes in underused land areas and commercial activity in the central areas of 37 core cities. Finally transformation factors from underused land to business-use and residential land were evaluated with an emphasis on the influence of the proximity to a railway station.Between 1985 and 2005, the results show that small areas of underused land have decreased in central areas, but there is a net increase of underused land. Additionally, commercial activity and population have declined in central areas compared to national trends and the average of core cities. Analyses of transformation factors reveal that outdoor parking lots negatively impact the transformation, but the combination of constructing of railway stations close to central areas and adopting land-use zoning for business-use and residential land have a positive affect on the transformation of underused land. 相似文献

As part of a programme examining the effectiveness of land tenure forms − tenure administration system combinations, the paper examines how and why beneficiaries use land registration in Project 2, a state subsidised housing project in Mbekweni, South Africa. The ownership − registration combination can have a number of negative consequences when policy makers focus on economics alone, rather than the complete set of factors that are critical for registered ownership to work in poor urban communities. South Africa’s state-subsidised housing programme has created up to 3.7 million housing opportunities. Off-register secondary transactions constitute a major problem when the properties registered in ownership. Building on a series of related case studies, an evaluative schema classifying an ownership − registration combination as strong, semi-strong, semi-weak or weak is presented, along with the main findings from three previously reported case studies where the combination was classified as semi-strong. The beneficiaries in Project 2 were predominantly in-migrants from a rural customary area, and based on earlier work and the literature, a weak or semi-weak classification was expected. However, the case was classified as semi-strong. Ongoing, visible administration is possibly a major factor underlying this classification. 相似文献

Large-scale land deals have attracted considerable attention for various reasons, including their implications for local livelihoods. While some view the phenomena as a development opportunity, encompassing improvement in the livelihoods of local people, others argue that it is an impoverishing scheme. Ethiopia ranks among the top in terms of the size of land leased out over the last decade. Land is a major resource of state control and investment in Ethiopia. As the foundation of their livelihoods and identity, it is simultaneously a vital resource for the local people. Highlighting the importance of land for local livelihoods and state-society relations and employing a political-ecological approach, this paper analyzes the outcomes of two land lease cases for the local people in Bakko Tibbe district of Oromia, Ethiopia. The findings show that the land leases induced a significant decline in local people’s access to land, resulting in a significant reduction in crop production and livestock husbandry. The land leases also dismantled longstanding land-based social relations in both production systems. Based on empirical evidence from specific localities and contextualizing the local livelihood dynamics within broader political-economic conditions, this study contributes to the ongoing debate on livelihood impacts of global land deals. 相似文献
