This paper describes micro‐economic models of land use change applicable to the rural‐urban interface in the US. Use of a spatially explicit micro‐level modelling approach permits the analysis of regional patterns of land use as the aggregate outcomes of many, disparate individual land use decisions distributed across space. In contrast to the models featured by Nelson and Geoghegan, we focus on models that require spatially articulated data on parcel‐level land use changes through time. In characterising the spatially disaggregated models, we highlight issues uniquely related to the management and generation of spatial data and the estimation of micro‐level spatial models.  相似文献

Land administration systems, and particularly their core cadastral components, are an important infrastructure which facilitates the implementation of land use policies. While most land administration systems traditionally have a primary objective of supporting the operation of land markets, they are increasingly evolving into a broader land information infrastructure which supports economic development, environmental management and social stability in both developed and developing countries. While a great deal of attention is given to land use policies worldwide concerned with such areas as forest management, coastal zone management, environmental sustainability and managing the urban environment, less attention is given to the infrastructures which facilitate the implementation of the associated policies and programmes. Importantly, all these activities rely on some form of land administration infrastructure which permits the complex range of rights, restrictions and responsibilities in land to be identified, mapped and managed as a basis for policy formulation and implementation. As a result, there is an increasing interest in the concept of land administration infrastructures and their core cadastres, in the principles and policies concerned with establishing such infrastructures and in “best practices”. In addressing this need, this paper attempts to explain the evolving concept of land administration infrastructures, the concept of “best practice” and the concept of a land administration “tool box” of principles, policies, laws and technologies which are useful in reforming or re-engineering land administration systems in support of a broader land policy agenda.  相似文献

Conventional land tenure recording approaches to create a sustainable land administration system (LAS) have been found to be of limited value in developing countries. To respond to this challenge, the ‘fit-for-purpose’ (FFP) approach was developed. This approach has gained relevance in the last years and promotes the use of new technologies like unmanned aerial vehicles (UAV) to provide valuable base maps. Yet, contemporary failures demonstrate that technological innovations should consider the governance context when being implemented. Understanding the relevance of the FFP approach and acknowledging the importance of institutional factors in policy implementation, this research presents and applies the ‘Fit-for-purpose governance assessment framework’ (FGAF). The FGAF operationalises the seven elements of the FFP approach with five governance dimensions of the framework named Governance Assessment Tool (GAT). To apply FGAF, our selected case study is focused on the UAVs implementation in Rwanda. We conducted 37 semi-structured in-depth interviews, a pilot project with Rwandese stakeholders, and analysed several official documents and national reports. Additionally, UAV data collection was carried out to test the performance of the technology too. This research found that participation and flexibility are the governance qualities that present the main challenges, while inclusiveness, affordability, upgradability, attainability and reliability provide better opportunities to implement UAVs. Based on our case study, we conclude that the governance context favours a top-down approach for the implementation of the UAV technology in the LAS. For the sustainability of the LAS, the central government should incentivize participatory governance models for local and non-governmental actors. Also, strengthening the capacities of the field agencies at the district level through fiscal decentralisation can support the effective uptake of the UAV technologies in the LAS.  相似文献

In this study we set out to critically examine the environmental governance of native forests owned and managed by the Maori in New Zealand, with a specific focus on ‘SILNA’ lands given to the South island Maori as compensation lands for lost ancestral tribal lands. We will interrogate reasons for different forestry pathways in terms of how the process of European colonisation unfolded politically and spatially, the response of the Maori SILNA forest owners to pressures linked to land allocation and land rights issues over time, and the repercussions of these responses for biodiversity preservation in indigenous forest management systems. In order to unravel the complex environmental governance processes at play in the New Zealand context, we will pay particular attention to ‘exogenous’ (i.e. propelling forces outside Maori communities) and ‘endogenous’ regulation mechanisms (i.e. regulation of native forest management within SILNA forest blocks). New Zealand is a particularly appropriate setting as Maori governance, forest management and land rights issues have come to the fore over the past decades. Our findings suggest that Maori SILNA forest owners have used the full spectrum of forest management pathways, ranging from outright clearfelling and associated biodiversity depletion to forest preservation. The study highlights the complex interplay between endogenous environmental governance processes (actor embeddedness with their land and the role played by trusts and committees in particular) and exogenous drivers, in particular through the influence of international logging companies, and the policy environment which has sent mixed, and at times confusing, messages to Maori SILNA native forest owners.  相似文献

The meaning of land and land policies is diverse and contested across and within local and (inter)national settings. The phrase ‘land policy’, used to refer to all policies that have anything to do with land, may be convenient, but it masks the actual complexity of issues. Meanwhile, concern for ‘pro‐poor’ land policy has coincided with the mainstream promotion of efficient administration of land policies, leading to the concept of ‘land governance’. Such concepts have enriched discussion on land issues, but they also complicate further an already complex terrain. In response, this paper offers possible analytical signposts, rather than an actual in‐depth and elaborated analytical exploration of this terrain. It hopes to be a modest step forward and towards a better understanding of contemporary policy discourses and political contestations around land and land governance.  相似文献

Many experts agree that more agricultural investment is needed in the global South to improve local food security and reduce poverty. However, there is a lack of consensus about the types of investment needed to achieve these goals. This paper contributes to the literature on large agricultural investments and corresponding business models by inventorying and analysing such investments in Kenya’s Nanyuki area. We identify four clusters of business models that differ primarily by type of production and other distinct determinants, namely: demand from markets; access to land; land tenure regime and colonial history; actors involved; biophysical context; labour availability; and governance of the value chain via private standards. The study results shed light on the factors that help or hinder implementation of large agricultural investments and shape their impacts in the context of African land use systems. The way land is accessed represents one of the most-decisive factors determining the risks and opportunities associated with such projects. We find that most investments in the Nanyuki area occur on land bought or leased from private owners.  相似文献

In the 21st century, the U.S. has experienced a boom in unconventional oil and gas development (UOGD). In part due to advances in technology, this rapid increase in UOGD has moved extraction practices into geographic areas that have previously seen little or no oil and gas development. As a result, conflicts over property rights have erupted—particularly in relation to split estate situations. To understand this controversy, we must situate it in the conditions which have shaped land use and mineral rights. We argue that past federal and state level governance decisions have created the conditions for UOGD conflicts today. Here, we utilize historical institutionalism (HI) to review the historical actors, processes, and institutions that have shaped how mineral rights have developed in the context of split estates in the U.S. We suggest that tracing this legislative and judicial history through HI is an essential foundation for exploring issues related to UOGD. Most importantly, we highlight these processes of governance as a bedrock for understanding spatial inequality inherent in current split estate law that grants the mineral estate dominance over the surface estate. We suggest that this codification of spatial inequality is problematic both in and beyond the context of split estates in UOGD.  相似文献

Enticing economic benefits for host nations and the notion of large areas of land considered available are often put forward as the main reasons for large-scale land acquisition in many areas of sub-Saharan Africa. However, country-level datasets of land acquisitions seem to indicate a clear divide between a majority of countries engaged in land acquisitions as investors and those involved as targets. We posit that there are socio-economic and governance factors that make the engagement between targets of land acquisitions and investors both unequal and attractive to large-scale investments. We then ask the question: what are the factors that make communities vulnerable to an unequal engagement with large-scale land-investing interests in Sierra Leone? We explore this question using local-level socio-economic data of households and communities in two settings where land acquisitions have occurred in Sierra Leone. We find that socio-economic characteristics of local populations, such as levels of education, the powerful role of traditional chiefs and corruption, make these areas easier targets for such land investments. Investors also exploit the poor economic situation of local areas by making alluring promises of development opportunities. The vulnerability of local people to land investors is further undermined by poor governance at the national level and external politico-financial interest in favor of such investments. Local populations are vulnerable to organized campaigns of land acquisitions by multi-national companies. Proper legal and institutional frameworks are required to protect local interests in these land deals.  相似文献

研究目的:明确国土空间用途管制的科学内涵,讨论新时代统一国土空间用途管制体系的基础性问题。研究方法:理论分析法和归纳演绎法。研究结果:(1)国土空间用途管制的对象是一个空间、属性与行为三位一体的复杂系统,管制实施中需协调好实体空间、功能空间与管理空间的关系。同时,异质性、动态性与尺度性等主要空间属性影响着管制实践的效率。(2)新时代国土空间用途管制完善了用途管制理念方法,但实践的滞后性引发了系统治理思维与分区分类管控的矛盾,空间尺度性与事权划分不匹配,管制手段中审批与许可关系不清等问题。(3)机构改革为自然资源统一管理带来机遇,但管制主体的职能界限模糊与"上下不对齐"的治理结构设置也带来了新的挑战。研究结论:国土空间用途管制在国家现代化治理体系中发挥着举足轻重的作用,内容体系逐渐完善,但基础理论认知和管制实施的矛盾仍旧突出,需要在今后的实践中不断改进。  相似文献

Improvements to forest and land governance are key to addressing deforestation and degradation of peatlands in Indonesia. While this is a priority area, the steps to achieving good forest and land governance have been under-researched. There is a need for better links between theoretically informed academic analysis and work in the field. This study drew together a panel of experts on forest and land governance using a Delphi method to discuss the underlying drivers of deforestation and peatland degradation, and correspondingly, to identify interventions to improve land and forest governance in Indonesia. Seventeen panelists with an average of more than 12 years’ experience reached agreement over four governance interventions: increasing the capacity of local communities to manage and monitor forests and natural resources (65% of panelist’s votes); identify strengths and weaknesses of community organisations and institutions, and develop strategies to improve their performance (65% of panelist’s votes); gazetting forests to clarify land boundaries and determine which areas should be village, community and state forest zone (59% of panelist’s votes); and, integrating participatory community maps into spatial plans to protect local communities and indigenous peoples’ development needs (53% of panelist’s votes). They also supported action research involving the government, private sector and communities, and political economy approaches to researching forest and land governance issues. Panelists indicated that community level approaches such as securing community forest tenure through clarifying land claims and integrating local land tenure into spatial planning had an important role in sustainable forest management.  相似文献

Within the scope of the developments in public administration after the 1990s, “Good Governance” approach has been preferred instead of the traditional public management approach. Good Governance is a fair, impartial and egalitarian management model that is based on co-management and envisages the participation of all actors (e.g. public and private sector, civil society) in decision-making processes. With this new management model, public institutions in Turkey began to realise good governance based reforms, especially in areas where they establish a close relationship with citizens. In this article, changes in the public administration in Turkey together with good governance and the effects. The effects change on the land registry and cadastre processes are discussed. In this regard, a situation is evaluated in the context of the future Government 3.0 process by discussing the successful and incomplete aspects of good governance in land registry and cadastre practice in Turkey.  相似文献

The aim of the Land Administration Project (LAP) policy reform for supporting the establishment of the Customary Land Secretariats (CLSs) is to formalise and strengthen customary land administration and management within the context of decentralised land administration. With the prospects of the CLSs becoming the legal local land administrative units, the paper assessed how traditional land governance institutions may have contributed to the decentralisation of land administration in Ghana. The research used case study strategy within the qualitative research paradigm and un-structured questionnaires were used to collect data. The analyses show that, simple land registries exist with traditional local governance institutions through the CLSs. The maintenance and effectiveness of this however depends on continuous improvement of records keeping, quality of office personnel and suitable office accommodation. This should be devoid of local power struggles among current and successive chiefs. Also, collaboration with public land sector agencies especially in areas of sharing information on rights, uses, disputes and preparation of planning layouts is paramount. These registries are mere extension of the state land administration apparatus as service units under the deconcentration of land administration powers. The paper concludes that the current policy focus on strengthening decentralised land administration through the CLSs may fail if attention is not given to the maintenance of the local registries. Revenue generation capacities of the CLSs need to be enhanced in order for them to recruit and maintain quality office staff, and acquire technical logistics. Decentralising land administration to the CLSs under the deconcentration of powers should be maintained in the interim because of the teething problems identified with this current system.  相似文献

Liberalisation of agricultural policies reduces the influence of policy on land‐use decisions, but environmental policy objectives remain. Governance provides an approach that recognises the role of institutions and collective action. The formulation of environmental policy objectives in terms of the provision of public goods raises questions as to the role of economic valuation and as to whether the definition of ‘goods’ may misdirect policy attention. An alternative approach relates to ecosystem services and sees management issues in terms of ecosystem resilience and the adaptive governance of socio‐ecological systems. Governance involves a mix of regulation, markets, government incentives and collective action. Regulation sets the domain within which markets operate and social judgements as to property rights are required as a basis for exchanges. Depending on commodity prices, agri‐environment schemes may be required either to reduce agricultural production intensity or to keep land under production. The diffuse nature of the environmental benefits and costs of land uses, the complexity of ecosystems and the need to co‐ordinate land management decisions indicate a role for local adaptive co‐management of land resources. Governments play a major role in supporting the institutional framework within which this can take place.  相似文献

China's economic reforms over the past decades have given rise to the development of a rudimentary urban land market. Although one cannot speak of a land “market” in the strict sense of the word, there is an urban land allocation system in which land lease rights can be acquired through the payment of a land-use fee. If the urban land market is to develop in a sustainable manner, new credible institutions need to be established that can safeguard greater legal security and transparency. For these purposes, it is necessary to establish a management system that can support the legal (tenure security), economic (leases, taxes) and broader aspects (spatial and environmental land use policies) of land administration. To make an urban land administration system socially credible and functional, land-related information should be registered and structured at a detailed spatial level, such as parcels. There is no parcel-based information system in China, but the country has developed a population registration system at a detailed spatial level that could be a starting point to develop integrated information systems, or a so-called “local spatial data infrastructure”. This paper reviews China's population registration system and their spatial units and presents a proposal for an information system that can be expanded or adapted to meet the requirements of an effective land administration system.  相似文献

Megaregion has emerged as a new dimension of global urbanization. A megaregion approach based on polycentric strategy is deemed to enhance regional economic competitiveness. Numerous studies have highlighted the economic benefits, celebrated the spill-over effects, and outlined the creative potentials of contemporary megaregion policies in different nations worldwide. However, further policy instruments require the knowledge about the achievement and failure of megaregion policies that seek for spatial, economic, social, and environmental efficiency and sustainability. This paper introduces China’s megaregion policy and proposes an analytical framework for performance evaluation from four principle domains (rational urban growth, economic development, social equity, environmental protection) at three levels (internal collaboration, integral development, and overall development). Using a case of the Megaregion around Hangzhou Bay (MAHB), we find very limited success of China’s megaregion policy. In particular, the megaregion policy only accomplishes the economic goal, and fails to achieve the goals of rational urban growth, environmental protection, and social equity. A series of mechanism based regressions are established and show that the implementation duration of megaregion policy: (1) associates positively with the economic growth; (2) relates negatively to social equity and urban rational growth; and (3) has no significant relationship with improved environmental quality. Institutional fragmentation, no unified spatial planning, and inadequate legislation at megaregional level are the underlying causes of the expected performances within the policy context of governance itself. We finally propose some possible solutions and discuss the implications for spatial polycentric governance. The demonstrated methodological framework can be applicable to other megaregions around the world. This paper is thus believed to provide some new insights for land use policy.  相似文献

This paper presents a holistic method by integrating three concepts (land resources management, assets supervision and political governance for sustainability) for investigation of land administration in China, taking into consideration of cultivated land protection for a testimony with econometric method. Theoretically, in this self-organizing integrated method, land resources management focuses on the productivity of land; land assets supervision centralizes on the realization of land usufruct rights in land transference; land political governance for sustainability concentrates on harmonious linkage of economic efficiency, social stability and environmental safety of land use. Their interrelations are complex. Methodologically, the results indicate that the theoretical model is feasible to explain variations of cultivated land protection with these three concepts. Cultivated land decreases with increasing land value increment multiples, and is positive with political governance concept, but not in a linear fashion. Finally the results suggest that roles of government in land administration need to be changed and strengthened, supporting complete compensation for land expropriation and modification to policies of cultivated land.  相似文献

This paper provides a constructive critique of Corrine Cash's paper “Good governance and strong political will: Are they enough for transformation?”, published in volume 58 of Land Use Policy in 2016. By focusing on how intra-sector dynamics influence land use policies in conflicts revolving around urban sprawl, this paper aims to complement and, to some extent, widen the analytic lens deployed by Cash. The examination of the Spanish wine sector and its lack of zoning policies confirms Cash's argument about the need to go beyond discourses of ‘good governance’ and ‘strong political will’ to understand the dynamics underpinning real spatial processes. However, this exploration underscores the need to add layers of complexity to land use analyses, showing the relevance of intra-sector conflict and logics. In complicating any simplistic reduction of urban sprawl conflicts to rural–urban oppositions, the paper ultimately calls for a more dynamic and multiscalar planning theory to address complex governance issues.  相似文献

研究目的:归纳分析2021年国内外土地管理领域研究进展,展望研究趋势。研究方法:文献研究法。研究结果:2021年,国内土地管理领域研究涉及国土空间内涵、中国共产党百年土地史、自然资源资产产权制度改革、农村土地管理法律以及存量低效用地利用等;在国际上,土地权利平等、农田保护、土地信息化管理等问题备受关注;土地制度历史变迁、土地市场管理、土地产权与农田保护是国内外研究共同关注的重点。研究结论:2021年土地管理研究紧扣理论问题与实践需求,在探索国土空间治理基本概念、土地制度历史变迁以及自然资源资产管理等方面取得了进展,但在土地管理基本理论、土地法解释论研究以及土地资源利用关键技术等方面仍有待加强。2022年土地管理领域或将重点关注土地管理基础理论探索、土地要素市场化改革与城乡土地收益分配、自然资源资产产权制度改革和治理体系构建、土地管理专项立法、面向双碳目标与生态保护修复的国土空间用途管控、城乡空间高质量发展、耕地资源长效保护、土地信息化管理等议题。  相似文献
