This article explains the origins of s.4 of the Employment Act 1980 and assesses the place of this provision in the corpus of labour legislation enacted by the Conservative government since 1980. Its principal aim is to concentrate upon the concept of reasonableness which is central to the operation of the provision and to evaluate critically the role of the EAT and the industrial tribunals in interpreting it. This article examines the effects of the 1909 Trade Boards Act on women's wage rates and income contributions to poor households. The Act established boards charged with setting minimum hourly wages in selected low-paid trades, and the majority of workers affected before the First World War were women. Many of the women whose wages were raised by the Act were the wives and daughters of low-skilled workers, while many others were sole earners who supported children or elderly parents. Our main finding is that the Trade Boards Act was effective in reducing household poverty rates among the women whose wages it would have increased. 相似文献

Flexible work designs and employee well‐being: examining the effects of resources and demands

Advances in communication technology continue to expand the possibilities for redesigning work environments to allow for temporal and spatial flexibility. Although flexible work designs (FWDs) are typically launched with high expectations, recent research shows that FWDs also pose challenges to employees and can even impede employee well‐being. Based on the Job Demands–Resources model, we argue that FWDs offer both advantages (FWD‐related resources) and challenges (FWD‐related demands) to employee well‐being. The results (n = 999) show that FWDs are related to employee well‐being through several positive and one negative pathways. FWDs are positively associated with employee well‐being through enhanced work/life balance, autonomy, and effective communication and negatively associated with employee well‐being through increased interruptions. Thus, we introduce a framework that reveals the underlying positive and negative mechanisms in the relationship between FWDs and employee well‐being. 相似文献

The study examines whether factors related to customers' perception of employees' behavior in terms of customer perceived role ambiguity, role overload and customer-employee rapport influence the development of brand equity in the professional service context. 632 customers of one of the Big Four auditing companies participated in the study. The results of structural equation modeling show negative effects of role ambiguity and role overload on brand associations, perceived quality and brand loyalty, which constitute brand equity. The findings indicate a positive effect of customer-employee rapport on the enhancement of B2B brand equity. However, the negative influences of role ambiguity and role overload on customer-employee rapport transfer detrimental indirect effects on brand equity. The study contributes to an understanding of how the real interaction between service providers and customers can influence brand equity in the professional service setting. 相似文献

Because of increasing levels of competition and decreasing product life cycles, a firm's ability to generate a continuous stream of innovations may be more important than ever in allowing a firm to improve profitability and maintain competitive advantage This paper investigates several issues that are central to an examination of the innovation productivity in a firm. First, the relationship between a firm's commitment to research and development and its innovative outcomes is examined. Two innovative outcomes are analyzed: (1) invention, which focuses on the development of new ideas; and (2) innovation, the development of commercially viable products or services from creative ideas. Invention is measured by the number of patents granted, and innovation is assessed by the number of new product announcements. Second, because many inventions ultimately result in marketable innovations and because patents may provide protection for new products, the relationship between patents and product announcements is also investigated. Finally, the ability of a firm to benefit from its inventions and innovations is studied by examining their separate effects on firm performance, measured as return on assets (ROA) and sales growth. Drawing from a sample of 272 firms in 35 industries over 19 years, the results from a model of simultaneous equations provided support for some of the hypotheses, but several other surprising findings were found. As expected, R&D spending was positively related to patents. This finding is consistent with others who argue that internal research capabilities, particularly those with a strong basic research component, is key to enabling a firm to generate creative outputs. More surprising was the finding of increasing returns to scale to R&D spending. While this contradicts much of the existing research, it is consistent with economic arguments for the advantages of scale in innovation. Also interesting is the finding that, while a significant curvilinear relationship exists between R&D spending and product announcements, it is not the predicted inverse‐U but instead a U‐shaped relationship. Consistent with previous work, product announcements were found to be positively related to both performance measures. A negative relationship was found between patents and both ROA and sales growth. While these findings were unexpected, they are intriguing and call into question the value of patents as protection mechanisms. In addition, these results may be resulting from the rise of strategic patenting, where an increasing number of firms are using patents as strategic weapons. The longitudinal study reported herein examines the buffering effects of individual and social resources (emotional intelligence and the leader-member exchange relationship) on the relationships between job insecurity and employee reactions (somatic complaints and organizational commitment) and the relationships between employee reactions over time. The results of this study, which was based on data drawn from 157 nurses employed by three hospitals in China, indicate that emotional intelligence moderates the relationship between job insecurity and somatic complaints at both Time 1 (T1) and Time 2 (T2) and that the leader-member exchange relationship (LMX) buffers the effects of somatic complaints at T1 on organizational commitment at T2. Overall, the findings reveal that the ability of employees to deal with their emotions and their relationships with their supervisors is an important resource that serves to protect employee outcomes when job security is uncertain. 相似文献

Managerial control and the limits to employee participation in retail work spaces: evidence from a UK IKEA store

This article contributes to labour process debates around managerial control and worker autonomy in the retail workplace. Through critical analysis of managerial strategies in the production of organisational space within an IKEA store, it explores how spatial design and practice shape managerial control and employee participation. Rather than the rhetoric of employee participation espoused by IKEA, our findings emphasise how managers use space to foster employee commitment to corporate objectives. While employees do exercise their own agency and spatial practice, their actions are moulded and constrained by dominant organisational structures and managerial strategies. As such, the article augments existing labour process research by developing new insights about how the spatial dimension shapes managerial control in retail workplaces. Although workers are far from the passive recipients of management decisions apparent in much labour process theory, their participation largely serves the strategic visions and spatial plans of their employer. 相似文献

The CAN-SPAM (Controlling the Assault of Non-Solicited Pornography And Marketing) Act significantly modifies the legal understanding of spam, offers important protections for consumers and, at the same time, holds the company primarily responsible for e-mail sent by salespeople on its behalf. This new law prohibits deceptive headings, using e-mail addresses obtained illegally, requires senders to have a working unsubscribe system, assesses liability, and criminalizes certain types of e-mail actions. Statutory damages are ascribed at up to US$2 million for violations, tripled to US$6 million for intentional violations with unlimited damages for fraud and abuse. Since commercial e-mail messages have become such a vital medium of communication for salespeople, it becomes imperative that sales strategies comply with and benefit from this new regulation. Therefore, this paper serves to clarify the implications of the CAN-SPAM Act for salespeople and sales managers. Specific managerial guidance on how the sales force can comply with this law is provided. 相似文献

The Mills-Muth urban residential land use simulation model is extended to include two residential income classes and a proportion of residential to urban land that varies with distance from the CBD. Land area, population, households, population density and residential property value are simulated for the central city, its suburbs and the Milwaukee urban area for the years 1977, 1980, 1985, 1990 and 2020, for two scenarios that differ primarily with respect to income growth rates and automobile commuting costs. State-owned enterprises (SOEs) contribute approximately 10% of the world’s GDP. SOEs at one time were predicted to disappear from the economic landscape of the world, but today SOEs are growing more prevalent in the world economy. The current theories of the firm that form the pillars of the management discipline largely ignore the theoretical differences that SOEs introduce into the conceptualization of the firm. Therefore, we extend four core theories of the firm by incorporating SOEs as a mainstream (not special or marginal) organizational form into these theories. We focus specifically on property rights theory, transaction cost theory, agency theory, and resource-based theory, culminating in a research agenda with 12 testable propositions. 相似文献

The intended purpose of the 1887 Interstate Commerce Act (ICA) was the establishment of the Interstate Commerce Commission (ICC) as a regulatory agency that initially provided oversight of rate and entry of interstate commerce in the rail industry. The ICC’s jurisdiction later included regulation of trucking and bus transportation. An unintended consequence of ICC regulation was the development of labor markets in these sectors that helped promote labor organization and labor rent sharing. Indeed, some of the most influential unions in American labor history represented workers in ICC-regulated industries. United States President George W. Bush recently signed an economic stimulus bill into law entitled the Job Creation and Worker Assistance Act. The law issues a number of directives aimed at increasing corporate capital expenditures in hopes of revitalizing a sagging economy. In this article, we focus on the increased amount of depreciation allowed in the first year following a qualifying capital investment. Specifically, an “additional” 30% of depreciation is allowed in the first year for ail personal property assets (20-year asset classes or less). This is clearly a significant change. Here, we derive “new” depreciation tables for personal property classes with the adjusted rule, both for MACRS and AMACRS, and illustrate the impact on capital investment decisions. 相似文献
